Page 1 of 2 <br />RESOLUTION NO. 48-2022 <br />A RESOLUTION OF THE BOARD OF PUBLIC WORKS FOR THE <br />CITY OF SOUTH BEND, INDIANA <br />POLICY FOR ESTABLISHING TEMPORARY PARKLET INSTALLATION <br />WITHIN CITY RIGHT-OF-WAY <br />WHEREAS, the Board of Public Works the (“Board”) is a contracting body of the <br />City of South Bend (the "City") and exists and operates under the provisions of I.C. 36-4- <br />9-5, as amended from time to time (the "Act"); and <br />WHEREAS, pursuant to I.C. 36-4-4-2(a); 36-4-5-3(7); 36-1-3-2; and 36-1-3-3, <br />the BPW has the power and duty to assist the Executive in the efficient and effective <br />operation of government of the City; and <br />WHEREAS, pursuant to I.C. 36-9-6-2 the Board is charged with the supervision <br />of streets, alleys, and other property of the City and pursuant to I.C. 9-21-4-3 is authorized <br />to approve placement of parklet structures within the City’s right-of-way; and <br />WHEREAS, pursuant to the City of South Bend Municipal Code Section 20-3 <br />(“Code”), the Board has the authority to approve encroachments into the City’s right-of-way <br />such has parklets; and <br />WHEREAS, temporary parklet installations have been requested by businesses and <br />therefore the Board has determined it to be in the best interest and safety of the City’s citizens <br />to establish a process to provide such parklets; and <br />WHEREAS, a parklet is defined as an area that converts existing on-street parking <br />into a public seating area. <br />WHEREAS, parklets located within the City’s rights-of-way are to adhere to <br />sound traffic engineering principles, in compliance with the Indiana Manual on Uniform <br />Traffic Control Devices and shall follow the guidelines established by the National <br />Association of City Transportation Officials’ Urban Street Design Guide, and be limited <br />in their locations; and <br />WHEREAS, BPW shall empower the City’s team of engineers, street, and public <br />safety professionals to establish the process for installation and recommending for <br />approval the installation of temporary parklets. <br />WHEREAS, the City Engineer’s Office has prepared a policy (“Exhibit A”) to be <br />followed when evaluating the installation of temporary parklets. <br />NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF PUBLIC
