<br /> <br /> <br />INTER-OFFICE MEMORANDUM <br /> <br /> DEPARTMENT OF PUBLIC WORKS <br /> DIVISION OF ENGINEERING <br /> <br /> <br />TO: Theresa Heffner, Clerk <br />Board of Public Works <br />FROM: Zach Hurst, Project Engineer <br /> <br />SUBJECT: Open Market Contract - Project No. 122-021 <br />Four Winds Field Player Facilities Improvements <br />DATE: October 3, 2022 <br />On July 12, 2022, the Board of Public Works opened and read aloud bids for the subject project. <br /> <br />One bid was received from Gibson-Lewis, LLC. Upon review of the bid package, it was <br />determined that Gibson-Lewis turned in blank M/WBE Utilization Forms. As such, they were not <br />able to meet the MBE and WBE goals of 1.5% and 3.9%, respectively. In accordance with the <br />Program Plan for the City’s MWBE Ordinance, the bid was rejected as non-responsive. <br /> <br />In accordance with City procurement policy, the project proceeded to the Open Market to find a <br />Contractor. Four contractors were solicited: Gibson-Lewis, Copper Rock Construction, Ancon <br />Construction, and Panzica Construction. Gibson-Lewis was the lone contractor to submit an <br />open market bid. <br /> <br />Gibson-Lewis submitted an open market bid of $1,348,000. Their bid paperwork was complete <br />and valid. Gibson-Lewis was able to meet the MBE goal of 1.5% and is being granted a waiver <br />for Good Faith Efforts with respect to the WBE goal of 3.9%. Gibson-Lewis solicited <br />subcontracting work from four (4) different WBE contractors. <br /> <br />One firm, Ritschard Brothers, submitted a bid to perform earthwork for the project. None of the <br />other firms contacted returned a bid to perform work. As outlined in the attached memo, <br />Ritschard Brothers’ bid of $371,668 was 34% higher than Indiana Earth’s bid of $278,120. <br />Awarding the subcontract to Ritschard Brothers would have caused a significant price increase <br />to the contract. <br /> <br />I recommend award of the Four Winds Field Player Facility Improvements to Gibson-Lewis <br />LLC, in the amount of $1,348,000. Funding is available through the Professional Sports and <br />Convention Development Area fund by way of PR-00016880. <br /> <br />
