1 <br /> tommitt e Z port: <br /> Public Works and Property Vacation Committee <br /> go tljt Common QCounti/ of ttjt City of foutb /Stub: <br /> The August 28, 1995 meeting of the Public Works and Property Vacation <br /> Committee was called to order by its Chairperson, Council Member Ann Puzzello at 4:00 <br /> P.M. in the Council informal meeting room. <br /> Persons in attendance included Council Members: Puzzello, Luecke, Kelly, <br /> Slavinskas, Zakrzewski, Washington, Coleman, Duda, and Ladewski; Brendan Bellina, <br /> Gaylen Alsop, and Kathleen Cekanski-Farrand. <br /> The first item on the agenda was to review Bill No. 41-95 which is a request to <br /> vacate an alley North of West Delaware Street. Mr. Gaylon Alsop the attorney for the <br /> petitioner made the presentation. He noted that t hi s originally beg an as <br /> part of the Violet <br /> Bradway Estate. John and Nicole Flint are the new owner of the property and discovered <br /> that in conveying the property that there is a garage built in the middle of the alley in <br /> question.They would like to vacate the alley and no property owners would be negatively <br /> by such vacation. Council Member Zakrzewski noted that the Board of Public Works sends <br /> the petition to the Council with a favorable recommendation. <br /> Following discussion, Council Member Kelly made a motion, seconded by Council <br /> Member Zakrzewski that Bill No. 41-95 be recommended favorably to Council. The <br /> motion passed. <br /> The Committee then reviewed Bill No. 42-95 which is a request to vacate an alley <br /> West of South Twyckeham Drive. Brendan Bellina made the presentation. He noted that <br /> when he purchased the property he was advised that the area in question was a five foot <br /> "pedestrian walkway". He quickly found out that there were motorcycles using the alley <br /> which resulted in noise, public safety problems, intimidation of relatives, and littering as <br /> well as harassment of his 15 year old niece. In light of the new baby in the family he <br /> believes that there is an overall public safety hazard.He had been ticketed by the City when <br /> he parked his car in the area and was advised by the City's Attorneys office that he would <br /> have to vacate the alley. Measurements by the City Attorney's find the area in question to <br /> be 4 foot 7 inches. <br /> Council Member Luecke noted that the Engineering Department set forth certain <br /> conditions a copy of which was given to the petitioner. <br /> Following discussion, Council Member Kelly made a motion, seconded by Council <br /> Member Zakrzewski that Bill No. 42-95 be recommended favorably to Council. The <br /> motion passed. It was also noted that the Board of Public Works in a letter dated August <br /> 28, 1995 made a favorable recommendation on the proposed vacation with all Departments. <br /> providing favorable recommendations (copy Attached). <br /> • <br />
