Committee Zeport <br /> Zoning and Annexation Committee <br /> ICo tfje Common Council of the City of *outb 3140: <br /> The July 25, 1994,meeting of the Zoning and Annexation Committee was called to <br /> order by its Chairperson, Council Member Lee Slavinskas at 3:47 P.M.in the Council <br /> informal meeting room. <br /> Persons in attendance included Council Members: Luecke, Washington, Kelly, , <br /> Slavinskas, Zakrzewski, Coleman, Duda, Ladewski and Puzzello; Ed Fisher, Don Fozzo, <br /> John Byorni,Don Porter, and Kathleen Cekanski-Farrand. <br /> Council Member Slavinskas noted that the first item on the agenda was to review <br /> Bill No. 51-94 which is a zoning request for the property located at 1129 Hickory Road. <br /> Mr. Byorni gave the staff report. He noted that both the staff and the Area Plan <br /> Commission send this proposed rezoning with a favorable recommendation. <br /> Mr. Ed Fisher a land surveyor spoke on behalf of the petitioner. He showed a Site <br /> Plan to the committee. The rezoning involves 80, 800 sq. ft. to be rezoned for a Physical <br /> Therapy office. The current building would be moved and not torn down. <br /> Following discussion, Council Member Duda made a motion, seconded by Council <br /> Member Washington that Bill No. 51-94 be recommended favorably to Council. The <br /> motion passed. <br /> The next item on the agenda was to review substitute Bill No. 58-94 which would <br /> amend Chapter 21 of the South Bend Municipal Code addressing zoning. <br /> Mr. John Byorni stated that this is a Area Plan initiated ordnance. He noted that it <br /> was discussed at the last Common Council meeting but because of concerns raised by the <br /> Council over accessory buildings it was continued. <br /> He noted that there had been meetings with Council Member Slavinskas and <br /> concerned individuals which resulted in former section being deleted from the Bill. It was <br /> noted that the amended version now deals with parking lot regulations, off street parking <br /> and loading and storage areas, parking in front yards, and noncommercial buildings and <br /> uses. <br /> Mr. Fozzo provided further explanation for the proposed changes. He sited L- <br /> shaped houses as a problem which are in technical violation of current zoning regulations. <br /> Mr. Byorni also raised the issue when houses are burnt whether they should be <br /> required to go through rezonings especially where they are located in different zoning <br /> classifications. Mr. Fozzo noted that these are difficult situations.He added that St. Joseph <br /> County provides that when a home is destroyed by fire or natural causes they are allowed <br /> to rebuild. <br /> Following discussion there was an overall consensus that residential units be <br /> permitted to rebuild when destroyed by fire or natural causes. <br />
