atommittss Z*port: Zoning and Annexation Committee 10 Os Common Couiutil of the City of 6outtj $ntb: The September 26, 1994 meeting of the Zoning and Annexation Committee was called to order by its Chairperson, Council Member Lee Slavinskas at 3:30 p.m. in the Council informal meeting room. Persons in attendance included Council Members Luecke, Kelly, Puzzello, Washington, Duda, Slavinskas, Coleman, Zakrzewski, and Ladewski; John Byorni, Richard Morgan, two Representatives from Mathews-Purucker-Anella; Don Porter and Kathleen Cekanski-Farrand. Council Member Slavinskas noted that the first item on the agenda was to review substitute Bill No. 70-94 which would amend Chapter 21 of the South Bend Municipal Code by addressing the topic of Recycling Drop Off Centers. Mr. John Byorni of the Area Plan staff noted that this is a revised version of the Bill originally proposed to the Council. He noted that he had met with Council Member Slavinskas, the Council Attorney, Council President Puzzello, and members of the staff to address the concerns previously raised by the Council.He then reviewed the changes. Council Member Slavinskas and Council Member Duda spoke in favor of the Bill. Following discussion Council Member Duda made a motion, seconded by Council Member Washington, that substitute Bill No. 70-94 be recommended favorably to Council. The motion passed. The Committee then reviewed Bill No. 88-94 which would amend Chapter 4, Article 3, Sec. 4-17 and create new Sec.4-47 entitled "Recycling Drop Off Centers". Council Member Slavinskas, the sponsor of the Bill made the presentation. He noted that this is a companion Bill drafted by the Council Attorney to compliment substitute Bill No. 70-94. It would provide a check and balance through the permit process for Recycling Drop Off Centers. Council Member Luecke asked several questions with regard to the proposed Bill. Following discussion, Council Member Duda made a motion, seconded by Council Member Washington that Bill No. 88-94 be recommended favorably to Council. The motion passed. The Committee then reviewed substitute Bill No.81-94 which is a rezoning request for the property located at 1809 and 1815 East Ireland Road.Mr. John Byorni noted that it received a favorable recommendation from both the staff and the commission with no remonstrance. Mr. Richard Morgan, the attorney for the petitioner, Memorial Hospital, made the presentation. He introduced two staff members from Mathews-Purucker-Anella Architect. He noted that the rezoning is necessary to allow Memorial Hospital to have the facility for six doctors. It will have the capacity to increase to a total of ten doctors. There are mature trees on the property which will stay.
