Committee Report <br /> Zoning and Annexation Committee <br /> To the Common Council of the City of South Bend <br /> The March 28, 1994 meeting of the Zoning and Annexation <br /> Committee was called to order by it's Chairperson <br /> Councilmember Lee Slavinskas, at 4: 00 p.m. in the Council <br /> Informal Meeting room. <br /> Persons in attendance included Council Members Luecke, <br /> Washington, Kelly, Puzzello, Slavinskas, Coleman, Duda, and <br /> Ladewski ; Jon Oxian, Jon Byorni, Don Fozo, Don Porter, and <br /> Kathleen Cekanski-Farrand. <br /> The first item on the agenda was to review Resolution No. <br /> 94-23 which is a request from the Board of Zoning Appeals <br /> for the property located at 402 South Street. <br /> Don Fozo made the presentation. He noted that the petition <br /> is for Habitat for Humanity who is seeking a special <br /> exception for combined use and also seeking a various from <br /> the required ten (10) parking spaces to four (4) parking <br /> spaces. The Board of Zoning Appeals at it's meeting of <br /> March 17th recommended favorable the special use exception. <br /> Following discussion, Councilmember Duda made a motion, <br /> seconded by Council President Puzzello, that Resolution 94- <br /> 23 be recommended favorable to Council . The motion passed. <br /> Council Member Slavinskas then noted that he has filled <br /> Substitute Bill No. 90-93 . He noted that this was discussed <br /> by the Committee last fall. Inlight of current state law, a <br /> majority of the Common Council must agree to sponsor such a <br /> Bill before it can be forwarded to the area plan commission. <br /> Following discussion the majority of Councilmembers present <br /> agreed that they would sponsor the Bill for procedural <br /> purposes only. A letter to that affect was to be drafted <br /> and be sent by the Council Attorney to the are Plan <br /> Commission and the City Clerk. <br /> Mr. Oxian noted that he has spoken with Kathy Dempsey and <br /> Jon Hunt who appeared to be in favor of the proposal . This <br /> was made in response to a question raised by Council <br /> President Puzzello. Councilmember Slavinskas noted that the <br /> Substitute Bill incorporates a three (3) year period as <br /> opposed to a five (5) year period originally purposed by Mr. <br /> Oxian. <br />
