All rights reserved. Page 4 <br />2. By Owner: <br /> <br />a. The City of Woodburn is a municipal corporation organized under the laws of the <br />State of Indiana, and maintains blanket insurance coverage over real and personal <br />property. Pursuant to Indiana Code 34-13-3-4, as amended from time to time, the <br />City’s liability is limited to: <br />1) Seven hundred thousand dollars ($700,000) for a cause of action that accrues <br />on or after January 1, 2008; and <br />2) Five million dollars ($5,000,000) for injury to or death of all persons in that <br />occurrence; and <br />3) A governmental entity or an employee of a governmental entity acting within <br />the scope of employment is not liable for punitive damages. <br /> <br />D. Additional Insureds: <br />1. The following persons or entities are to be listed on Owner’s general liability policies of <br />insurance as additional insureds, and on any applicable property insurance policy as loss <br />payees, as provided in Paragraph 6.04.B: <br /> <br /> <br />a. <br /> <br /> <br /> <br /> Engineer <br /> <br /> <br />b. <br /> <br /> <br /> <br /> Engineer’s Consultant <br /> <br /> <br />c. <br /> <br /> <br /> <br /> Engineer’s Consultant <br /> <br />2. During the term of this Agreement the Engineer shall notify Owner of any other <br />Consultant to be listed as an additional insured on Owner’s general liability and property <br />policies of insurance. <br />3. The Owner shall be listed on Engineer’s general liability policy as provided in <br />Paragraph 6.04.A.
