Zoning and Vacation Committee <br /> August 10, 1992 <br /> Page 2 <br /> Council Member Slavinskas noted that he had spoken with the developer and that the <br /> access road would be in place with the proper signage. Council Member Coleman then <br /> made a motion, seconded by Council Member Washington that Bill No. 48-92 be <br /> recommended favorably to Council.The Motion passed. <br /> The Committee then reviewed Bill No. 51-92 which is a rezoning request for the property <br /> located at 925 West Washington. Mr.Patrick Lynch who will be living in the house made <br /> the presentation. he noted that the rezoning is necessary to allow a duplex which was built <br /> in 1867 to moved to the area. The house is being displaced in light of the museum. He <br /> then showed pictures of the home in the area to the committee. <br /> Mr. John Byorni noted that both the staff and the Commission gave favorable <br /> recommendations to the proposed rezoning. If approved, the house will be moved <br /> pursuant to approval by a board of public works on August 19, 1992. <br /> Council Member Puzzello made a motion, seconded by Council Member Coleman,that Bill <br /> No. 51-92 be recommended favorably to Council. The motion passed. <br /> Council Member Slavinskas noted that Bill No. 54-92 is requested by the Petitioner to be <br /> continued until August 24, 1992. <br /> The Committee then reviewed Bill No. 39-92 which would amend Chapter 14 and Chapter <br /> 21 of the Municipal Code addressing swimming pools. <br /> Mr. Don Fozo made the presentation along with Mary Mueller of the City Legal <br /> Department. It was noted that there are two different definitions and two different <br /> requirements in light of whether a swimming pool was built prior to September 13, 1989. <br /> It was noted in response to a question raised by Council Member Zakrzewski that if there <br /> are changes to the pool or the fence except for routine maintenance that the new standards <br /> would apply. <br /> Council Member Slavinskas noted that he still believes the biggest risk are the unattended <br /> wading pools. In response to one of his questions it was noted that above ground pools do <br /> not need an inspection nor permit but below ground pools do require a permit and as five <br /> foot fence. <br /> Council Member Puzzello noted that most of the states have four foot (4') limit and that <br /> there is an additional cost involved to meet the five foot (5') standard. Mr. Fozo agreed <br /> with her comments. <br /> Mr. Byroni noted that the Area Plan Commission reviewed the zoning part only and <br /> recommends it favorably to Council. <br />
