COMFSISSYON r ~ f1 <br />i ~~,, ~ ~ ' (Airport Economic Development Area <br />,~ Public Improvement Project and <br />~ '~ y ~+ Taxable- improvement project) <br />z THIS SECOND ADDENDUM, made and entered onto this 5th day of <br />February, 193, by and between the South Rend Redevelopment Authority, <br />a body corporate and politic otgan~.zed and existing under Indiana CodA <br />3£r-7-14.5 thereinafter with its successors and assigns referred to as <br />the "Authority'}, and the South send Redevelopment Cissior., the <br />governing body of the South Bend Department of Redevelo~xnent and the <br />Redevelopme;tt nistrict of South Bend, Indiana (hereina€ter called the <br />"Lessen"}. <br />WITt~RSS ETf3 <br />In consideratit~n of the mutual covenants herein contained it is <br />agreed that the Lease (Airport Econam~.o De~,e7.cp;nent Ar~r~ ~•,iblwc <br />Improvement Project and Taxable Improvement Protect} previously <br />entered into between said parties as o€ the first day of August,. 1994, <br />as amended and restated on December 1, 1990, shall }~ further amended <br />as €ollews: <br />1. Section 2 of the Lease shall be and i~ereby is amended to read <br />a; fol,lvws; <br />Section ~. Lease, of Pra ect. In consideration of <br />the rentals and other terms and conditions herein <br />specified the Authority does hereby lease, demise <br />and Set to the Lessee the Project; fid HAVE AND To <br />f;JI.D the same with all rights, privileges, <br />easements and appurtenances thereunto belonging. <br />unto the Lessee for a term beginning on the date of <br />execution of this Lease, and ending on tt~e day <br />prior to such date twenty-two {22} years <br />thereafter. However, the term o€ this Lease shall <br />terminate at the earlier of ia} the exers;ise of the <br />option to purchase by Lessee and payment of the <br />aptic~n price, ar (b} the payment nr defeasarce of <br />all obligations of LeSSOr incurred (i.p to finance <br />the cast of the leased property, {ii} to refund <br />such ehligations, (ifi) to refund such re€undinq <br />obligations, or (Iva to improve the leased <br />property.
