Fox, M.D., PhD, MPH <br />Deputy Health Officer <br />Re: Lead Hazards located at 628 Park Ave., South Bend <br />Dear Mr. Goransson and Ms. McSweeney <br />Heidi Beidinger•Burnett, PhD, MPH <br />President, Board of Health <br />Jason Marker, M.D. <br />Vice President, Board of Health <br />On October 13, 2021, the Department of Health conducted a parent -request lead risl< assessment for lead hazards at the <br />subject address. A few lead hazards were identified at this address. Risk assessment results are included. In many instances, <br />only one component was tested in a particular area (room). If one component is tested in a room and found to be positive <br />and deteriorated, the owner should assume that any deteriorated paint on the similar components should be remediated <br />according to the options listed for the tested component. <br />Lead poisoning can cause permanent health problems in children, including brain damage, learning disabilities, behavioral <br />problems, and liver and kidney damage. In extreme cases, seizures and death can occur. Eliminating lead hazards will help <br />ensure that no children are lead -poisoned at that property. <br />In addition, property owners are required to disclose lead-based paint hazards to tenants. The Federal Residential Lead - <br />Based Paint Hazard Reduction Act, 42 U.S.C. 4852d, requires sellers and landlords of most residential housing built before <br />1978 to disclose all available records and reports concerning lead-based paint and/or lead-based paint hazards to purchasers <br />and tenants at the time of sale or lease or upon lease renewal. This disclosure must occur even if hazard reduction or <br />abatement has been completed. Lack of Knowledge about lead-based paint in the property must also be disclosed. In addition, <br />sellers and landlords must furnish a lead warning statement and a copy of the brochure "Protect Your Family from Lead in <br />Your House." Failure to properly disclose is a violation of the U.S. Department of Housing and Urban Development and <br />the U.S. Environmental Protection Agency regulations at 24 CFR Part 35 and 40 CFR Part 745 and can result in a fine of <br />up to $11,000 per violation. To find out more information about your obligations under federal lead-based paint <br />requirements, call 1 -800 -424 -LEAD. <br />Many lead hazards are easily fixed. Often all that is needed is a good cleaning and a fresh coat of paint. Please be advised <br />that knowingly exposing children to lead hazards may result in civil penalties, therefore we strongly recommend that you <br />eliminate all lead hazards. <br />Please contact Briannah McCall at (574) 245-6755 for assistance with addressing these lead hazards.
