Olunantittr mart <br /> THE ZONING AND VACATION COMMITTEE <br /> Olga the (gammon on Qlounrtt of the QCttg of*out!, limb: <br /> The February 25, 1991 meeting of the Zoning and Vacation <br /> Commitee was called to order by its Chairperson, Council <br /> Member Lee Slavinskas at 4:40 p.m. in the Council Informal <br /> Meeting Room. <br /> Persons in attendance included Council Members Luecke, <br /> Niezgodski, Soderberg, Puzzello, Slavinskas, Zakrzewski, <br /> Colmeman, Duda, and Ladewski; Mr. David Norris, Mr. Bernard <br /> Feeney, Mr. Sean Allan, Jenny Pitts-Manier, members of the <br /> new media, and Kathleen Cekanski-Farrand. <br /> The first item on the agenda was to review Bill No. 7-91 <br /> which would vacate an alley near Leeland and Ashland. <br /> The petitioner, Mr. Sean Allen, then gave the presentation. <br /> He noted that he resides at 814 Ashland Avenue. He noted <br /> that when he purchased the property there was a fence <br /> located there since 1978. He added a new fence and moved a <br /> shed toward the alley since it was not being used. He noted <br /> that the alley was overgrown with weeds and bushes, and that <br /> he cleaned the alley continuously. He was not aware that <br /> there was an encroachment onto the alleyway until it was <br /> brought to his attention. He noted that the fence and shed <br /> extend 2 (two) inches into the alley. <br /> Council Member Luecke, the District Councilman, noted that <br /> the alley is for the full length of 180 feet. He stated that <br /> the City does not use the alley, but that Mrs. Joyce <br /> Kaniewski, who resides at 820 Ashland Avenue, does use the <br /> alley for ingress/egress to her garage. It was further noted <br /> that vacating one-half of the alley would create a dead end <br /> alley and would not be acceptable. Council Member Luecke <br /> noted that there was a need to keep it open. <br /> Jenny Pitts-Manier noted that the Board may be receptive to <br /> a vacation only for the portion where the fence and shed <br /> extend into the alley. <br /> The Council Attorney noted that the best route would be for <br /> the petitioner to request a continuance at this evenings <br /> meeting, and amend Bill 7-91 so , that he would not have to <br /> pay an additional filing fee. <br /> Council President Niezgodski noted that the previous owner <br /> had encroached the alley, and that this was verified at the <br /> Board of Public Works meeting. <br /> Following further discussion, it was recommended that the <br /> Bill be continued indefinitely by Council Member Slavinskas. <br />
