LFed in Cler,, 5 Office APR "I 2022 RESOLUTION NO. 1-aJL, DAWN M.JONES LERK,SOUTH BEND,IN RESOLUTION OF THE SOUTH BEND PLAN COMMISSION APPROVING A RESOLUTION OF THE SOUTH BEND REDEVELOPMENT COMMISSION TO AMEND THE BOUNDARIES OF THE RIVER EAST DEVELOPMENT AREA AND APPROVING THE AMENDED AND RESTATED DEVELOPMENT PLAN FOR THE RIVER EAST DEVELOPMENT AREA WHEREAS, the South Bend Area Plan Commission (the "Area Plan Commission"), is the body charged with the duty of developing a general plan of development for the City of South Bend, Indiana(the"City"); and WHEREAS,the South Bend Redevelopment Commission(the"Commission"),the governing body of the South Bend Department of Redevelopment(the"Department')on April 14, 2022, approved and adopted its Resolution No. 3548 entitled "Resolution of the South Bend Redevelopment Commission Amending the Boundaries of the River East Development Area and the River East Development Area Allocation Area No. 1, Amending and Restating the Development Plan for Said Area and Regarding Related Matters" (the "River East Declaratory Resolution"); and WHEREAS, the River East Declaratory Resolution (i)designated and declared certain areas within the City to be redevelopment areas and an allocation area for purposes of tax increment financing to expand the existing River East Development Area;(h)added certain parcels of property to the River East Area property acquisition list; and (iii)approved an amended and restated development plan for the River East Area(the"River East Plan"); and WHEREAS, the Plan Commission desires to approve the River East Declaratory Resolution(the"Declaratory Resolution") and the River East Plan; and WHEREAS, the Commission has submitted the Declaratory Resolution and the River East Plan to the Plan Commission for approval pursuant to the provision of Indiana Code 36-7-14, as amended (the"Act"), which Declaratory Resolution and River East Plan are attached hereto and made a part hereof; and WHEREAS,pursuant to the provisions of the Act,the Plan Commission desires to issue its written order approving the Declaratory Resolution and the River East Plan; NOW, THEREFORE BE IT RESOLVED by the South Bend Plan Commission, as follows: 1. The Declaratory Resolution and the River East Plan conform to the plan of the development of the City. 2. The River East Plan is in all respects approved,ratified and confirmed.
