d <br /> Mr. C. Brian Sauers, an Attorney with Barnes & Thornburg, <br /> then presented a summary of Bill No. 26-88. He stated that <br /> the petition to vacate was filed with the City Clerk's <br /> Office on March 16, 1988 and that it is needed for Mr. Van <br /> Gates to continue the renovation and expansion of his <br /> automobile dealership in the downtown area. He noted that <br /> both Mr. Van Gates as well as Mr. Bill Gates were present. <br /> Councilman Niezgodski stated that he had talked with Mr. <br /> Bill Gates regarding the I & M pole and was assured that it <br /> would be moved. <br /> The Council Attorney noted that certain conditions were set <br /> forth by the Board of Public Works and their favorable <br /> recommendation on this vacation. She stated that she would <br /> recommend that if the Council would go forward, that the <br /> Bill be amended subject to those conditions. She also <br /> advised that she could have the amendatory language ready <br /> for this evening's Council meeting. The proposed amendments <br /> were acceptable to the petitioner and the petitioner advised <br /> the Council that they would have a letter addressing the <br /> cost of the relocation of the I & M pole. <br /> Following further discussion, Councilman Soderberg made a <br /> motion seconded by Councilman Coleman that Bill No. 26-88 as <br /> to be amended by the Council Attorney be recommended <br /> favorably to Council.
