He noted
that the Bill was substitute Bill which was a technical
correction to the legal description. He represented St.
Joseph Medical Center and showed a proposed preliminary site
plan of the area in question. The proposed rezoning
received a favorable recommendation for the Area Plan
Commission.
Following further discussion Council Member Luecke made a
motion seconded by Council Member Voorde that Substitute
Bill No. 69-88 be recommended favorably to Council. Mr. Jeffery N. Reece, the
property representative for Indiana & Michigan Power Company
explained that in their property audit which was internally
being conducted, it was discovered that the area in question
was believed to have been vacated back in 1922. However, in
light of the fact that there were no proper legal documents
located verifying such a vacation, it was recommended by the
Engineering Department that a re-vacation proceeding take
place. A copy of the minutes of the Board of Public Works
meeting of October 17, 1988 as well as a copy of a letter
dated October 18, 1988 was then submitted to the Committee
for review on the proposed vacation.
