Ne <br /> The May 11 , 1987 meeting of the Zoning and Vacation <br /> Committee was called to order by its Chairman, Councilman John <br /> Voorde, at 3:45 p.m. in the Council informal meeting room. <br /> Persons in attendance included: Councilmen Puzzello, Serge, <br /> Braboy, Voorde, Paszek, and Barcome; Ken Fedder, Ann Kolata, Rick <br /> Morgan , Bob Dunbar , Chris Davey , Mrs. Mangus, Tony Davey, David <br /> Chapleau, Norman Primus , and Kathleen Cekanski-Farrand,. <br /> Councilman Voorde noted that the first item on the agenda <br /> was to review the substitute version of Bill No. 21-87 which <br /> would amend Chapter 21 of the zoning provisions addressing <br /> exceptions in "C" commercial districts . <br /> Ann Kolata noted that the bill would amend Section 21-117.05 <br /> and would address a procedure where there is a "C" commercial use <br /> in existence on the first floor and where residential use is <br /> requested on the second or third floors above. She noted that <br /> this would require a procedure through the Board of Zoning <br /> Appeals and that all individuals living within three hundred <br /> (300) feet of the structure would be notified of the hearing . <br /> This topic has been discussed for a considerable period of <br /> time and is now being prompted by the sale of Max's Grocery <br /> Store. <br /> Following discussion by the Committee, Councilman Serge made <br /> a motion , seconded by Councilman Puzzello , to recommend <br /> Substitute Bill No. 21-87 favorably to Council. The motion <br /> passed . <br /> The Committee then reviewed Bill No. 25-87 which is a bill <br /> to vacate certain property known as the first east-west alley <br /> south of Mishawaka Avenue. Mr. Ken Fedder represented the <br /> petitioner. He noted that two (2) new optometrists would be <br /> coming to the city and that Area Plan gave a favorable <br /> recommendation to the alley vacation as did the Board of Public <br /> Works. <br /> He noted that he would be amenable to an amendment <br /> incorporating the two (2) conditions set forth by the Board of <br /> Public Works, namely a deed of dedication and a cross easement. <br /> The Council Attorney recommended that the conditions be <br /> specifically addressed within the ordinance. <br /> Following discussion , Councilman Serge made a motion , <br /> seconded by Councilman Puzzello, that Bill No. 25-87 (as amended <br /> by the conditions) be recommended favorably to Council .
