PAGE 11 <br />APPROACH <br />PAGE 11 OUR LADY OF HUNGARY NEIGHBORHOOD SRTS <br />SECTION 106 <br />• The project area is not located within or adjacent <br />to a historic district. No sites listed on the National <br />Register of Historic Places are located within the <br />project area; however, two “Outstanding” rated <br />sites, the Our Lady of Hungary Church & School <br />and the Toth State Bank, and one “Notable” <br />rated county survey site, the Weisser Market, is <br />located within or adjacent to the project area. A <br />Historic Property investigation may be required. <br />Additionally, archaeological investigation will <br />be required in areas of new disturbance. If the <br />Historic Property and Archeological investigations <br />determine that impacts to cultural resources will <br />be minimal, the project will be eligible for the <br />INDOT Minor Projects Programmatic Agreement. <br />All Cultural Resource coordination will be <br />performed by SJCA, Inc. <br />STREAM IMPACTS <br />• No streams are present within the project area; <br />therefore, there will be no stream impacts. <br />WETLAND IMPACTS <br />• The project takes place in developed residential <br />areas. Portions of the project area contain existing <br />sidewalk facilities, and areas that do not consist <br />of landscaped residential lawns. Based on a <br />desktop review, no wetlands appear to be present <br />within the project area. If any wetland features, <br />are discovered during field visits, they will be <br />delineated by Troyer Group to determine potential <br />impacts, which are expected to be minimal. <br />RIGHT-OF-WAY <br />• Impacts from ROW acquisition are expected to be <br />minimal. If greater than 0.5 acre of ROW acquisition <br />is required, the NEPA document will be elevated to <br />a CE-2 or greater. <br />THREATENED & ENDANGERED SPECIES <br />• Some residential trees are present within or <br />adjacent to the project area, providing potential <br />habitat for endangered bats. If the project includes <br />any tree clearing or trimming, it may result in some <br />minimal impacts to endangered bats. However, <br />impacts to habitat are not expected to be great <br />enough to warrant a “Likely to Adversely Affect” <br />finding from USFWS. Due to the limited scope, <br />any impacts to other species are expected to be <br />minimal. <br />SECTION 4(F) IMPACTS <br />• Rum Village Park, a recreational facility owned by <br />the City of South Bend, is located across Ewing <br />St. from the southern edge of the project area. <br />Additionally, Our Lady of Hungary School has an <br />outdoor recreation area that appears to be at least <br />partially open to the public. Both are considered <br />Section 4(f) resources. Impacts to both are <br />expected to be minimal, and will likely fit criteria <br />for an exemption from full Section 4(f) analysis. <br />Coordination with INDOT to determine the level <br />of Section 4(f) documentation needed may be <br />required. <br />ENVIRONMENTAL <br />Since federal funding is involved, preparation of a <br />NEPA document is required and will be completed <br />by Troyer Group. Based on the above-listed factors, <br />impacts from Section 106 and ROW acquisition <br />are likely to be the determining factors in deciding <br />the overall CE level. If the project meets the <br />MPPA and requires less than 0.5 acre of ROW, <br />a CE-1 will likely be required. If either of these <br />conditions are not met, the most likely CE level <br />would be a CE-2. Archaeological and/or historic <br />property investigation may be required, and will <br />be performed by a qualified sub-consultant. Troyer <br />Group will be responsible for the fulfillment of <br />any public involvement tasks, if the project meets <br />INDOT’s requirements for offering a public hearing. <br />ENVIRONMENTAL
