BILL NO. 04-22 ORDINANCE NO. 10842-22 AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, AMENDING THE ZONING ORDINANCE FOR PROPERTY LOCATED AT 2122 & 2128 SOUTH BEND AVE, COUNCILMANIC DISTRICT NO.4 IN THE CITY OF SOUTH BEND, INDIANA STATEMENT OF PURPOSE AND INTENT Request to rezone a portion of 2122 South Bend Ave. and all of 2128 South Bend Ave., to C Commercial to allow for an Automotive Lube Center to compliment the adjacent Drive and Shine facility. A portion of the small retail shops will remain. Petitioners desire to rezone the property from NC Neighborhood Center District to C Commercial District. NOW, THEREFORE; BE IT ORDAINED by the Common Council of the City of South Bend, Indiana, as follows: SECTION I. Ordinance No. 10689-19, which ordinance is commonly known as the Zoning Ordinance of the City of South Bend, Indiana, be and the same hereby amended in order that the zoning classification of the following described real estate in the City of South Bend, St. Joseph County, State of Indiana: That part of the Southeast Quarter of Section 31, Township 38 North, Range 3 East, City of South Bend, Clay Township, St. Joseph County, Indiana which is described as: Beginning at the Northeast corner of a Parcel of ground described in Deed Document Number 2021-43244 in the records of the St. Joseph County, Indiana Recorder's Office; thence S. 00°36'20" E. (All Bearings Assumed) along the East line of said Parcel, a distance of 247.87 feet more or less; thence, S. 89°29'21" W., a distance of 101.19 feet more or less; thence, S. 01 °41'49" E., a distance of 30.00 feet more or less; thence, S. 89°29'21" W., a distance of 61.42 feet more or less; to the Westbe and the same is herby established as C Commercial SECTION II. This ordinance is and shall be subject to commitments as provided by Chapter 21-12.07(f)(7) Commitments, if applicable. SECTION III. This Ordinance shall be in full force and effect from and after its passage by the Common Council and approval by the Mayor, and legal publication, and full execution of any conditions or Commitments placed upon the approval.
