049nunlflrr Erpurt <br /> Mu tip Cullum (IIounril of Up ( nig of l3oui ZONING AND VACATION COMMITTEE <br /> The April 29, 1985 meeting of the Zoning and Vacation Committee <br /> was called to order by its Chairman, Councilman John Voorde at 4: 00 p.m. <br /> in the Council informal meeting room. <br /> Persons in attendance included: Councilmen Paszek, Braboy, Zakra aski, <br /> Voorde, Puzzello, and Beck, Jim Wensits , and Kathleen Cekanski-Farrand, and <br /> Councilman Crone. <br /> Councilman Voorde noted that the Committee was to review Substitute <br /> Bill No. 14-85 which would re-zone the properties located at 1104 East <br /> Jefferson, 1105 East Wayne, and 220 South Eddy. He noted that in the <br /> letter from Dick Johnson of Area Plan dated April 17, 1985, that a public <br /> hearing on the Bill was held on April 16, 1985 by the Area Plan Commission <br /> with it voting 13 to 2 in favor or re-zoning the area to "A-Residential, <br /> A height and, area. It was noted however that the staff of the Area Plan <br /> Commission had recommended against the proposed re-zoning. <br /> Councilman Serge noted that many of the residents who spoke at the <br /> Area Plan meeting were concerned about keeping this area residential and <br /> they were very strong in number. They also expressed deep concern over the <br /> many school children crossing at the intersection of Eddy and Jefferson. <br /> Councilman Beck, the sponsor of the Bill, noted that the map which <br /> will be viewed this evening will show strong concentrations of residential <br /> neighborhoods. She also expressed concern over maintaining the area as <br /> residential, concern over the safety of the children, and noted that 197 <br /> signatures were presented in a petition in favor of the re-zoning. She <br /> noted that for over 20 years the property had been owned and maintained by <br /> the property owners just east on Jefferson. She also noted that she had <br /> requested a study of traffic counts to be made by the Engineering Department, <br /> and expressed concern that there was not a left turn signal when proceeding <br /> north on Eddy to Jefferson. <br /> Councilman Crone expressed concern over Ken Fedder' s comments to the <br /> Area Plan Commission regarding the possible de-valuation of property. She <br /> questioned the process and felt that the Council could be over-stepping its <br /> bounds. <br /> Councilman Voorde questioned whether the process could be in fact <br /> condemnation masquerading as zoning. He also expressed concern over ingress <br /> and egress if the property would be made available for commercial usage. <br /> The Council Attorney noted that the Council must determine what is the <br /> highest and best use for the property. It should take into consideration <br /> traffic considerations , safety, and how contiguous property is zoned and <br /> the character of the neighborhood. <br /> Councilman Puzzello believed that the residential integrity of the <br /> area should be protected. Councilman Braboy voiced concern that the Council <br /> should be listening to the people most directly affected by the re-zoning. <br /> Councilman Paszek also expressed concern over listening to the people and <br /> that the petition submitted should be carefully reviewed. <br />
