aLanttit :Dr ErpnrI <br /> On At Mammon Mound! of* (lug of Onutfi iirnd: <br /> zoning and Vacation Committee <br /> The March 26 , 1984 meeting of the Zoning and Vacation Committee <br /> was called to order by its Chairman, Councilman John Voorde at 5 : 15 p.m. in <br /> the Council informal meeting room. <br /> Persons in attendance included: Councilmen Beck, Voorde, Puzzello, <br /> ' Paszek, Braboy, Zakrzewski, Serge, and Crone, Douglas Carpenter, Sheryl <br /> Els3e <br /> Bressler, Carol Sheetz, Dick Johnson, Richard Hill, Mrs . D.R. Johnson, <br /> Bonavia, Mary Varga, Dick Maginot, and Kathleen Cekanski-Farrand. <br /> Councilman Voorde noted that this meeting had been called to again <br /> review Bill No. 19-84 which would re-zone approximately 31 acres along <br /> State Road 23. He noted that both the staff and the Area Plan Commission <br /> gave favorable recommendation to the bill. He also noted that the Council <br /> held a public hearing on the bill on March 12th and continued discussion <br /> until this evening' s meeting.in the public portion. <br /> Mr. Hill then briefly summarized the history of this re-zoning. <br /> He noted that the bill would clarify zoning for existing businesses and that <br /> it would bring it to the status it had in July, 1980 . No structure could <br /> be higher than 3 stories with C Commercial and a residental buffer. He noted <br /> that the area was zoned A. Residential, A height in area when it was annexed <br /> into the City and that re-zonings thereafter were compatible. <br /> Dick Johnson of Area Plan stressed that zoning of the 31 acres must <br /> be kept completely separate from the Hilton Motel project. The re-zoning <br /> would not affect Hilton if they had certain vested rights. Certain areas <br /> would remain residential classification and if they are desired for a use <br /> which would be commercial they would have to petition for a re-zoning. <br /> Mrs. Dan R. Johnson expressed her concern about the proposed <br /> re-zoning, and thought it was like calling nuclear missiles "peacekeepers" . <br /> She noted that she lives on Harrington and that the City came to her <br /> neighborhood and asked them to drop their fight against annexation and the <br /> City would protect them. She stated that now their property taxes have doubled <br /> and that she believed the City had gone back on its promise. She and several <br /> residents have attended over 40 meetings without success. Three residences <br /> have already been torn down. <br /> Mr. Johnson reviewed the aerial photo and explained why he believed <br /> the proposed re-zoning represented the "highest and best use for the <br /> affected properties" . <br /> Councilman Voorde noted that the bill was initiated. by the Area <br /> Plan staff in an attempt to recognize the highest and best use. The effective <br /> date of the annexation was May 9 , 1980 and the former re zoning was done <br /> in July of 1980. <br /> Mrs. Elsie Bonavia did not want anything to go above 2 1/2 stories <br /> and did not want any large developments. <br /> Mrs. Crone asked if the area which was annexed came into the City <br /> A Residential and was informed that it was. The legal department then <br /> notified the Area Plan Commission to intitiate proper re-zoning. It was noted <br /> •./[ flit. •—' wSL•ftbo co. <br />
