BILL NO. 22-01 <br />RESOLUTION NO. <br />A RESOLUTION OF <br />THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA <br />APPROVING AN INTERLOCAL AGREEMENT BETWEEN <br />THE CITY OF SOUTH BEND, INDIANA, THE CITY OF MISHAWAKA, <br />INDIANA AND ST. JOSEPH COUNTY, INDIANA, FOR THE MUTUAL <br />OPERATION OF THE SPECIAL VICTIMS UNITS <br />ADDRESSING CRIMES OF SPECIAL GRAVITY IN ST. JOSEPH COUNTY <br />WHEREAS, the City of South Bend, Indiana, through the South Bend Police Department <br />("SBPD") has a history of cooperating with the St. Joseph County Prosecutor in the investigation <br />and prosecution of crime within the City of South Bend; and <br />WHEREAS, St. Joseph County, Indiana, has created the Special Victims Unit ("SVU") <br />that conducts criminal investigations of child abuse and sex crimes deemed to have high impact <br />upon the safety and welfare of citizens of St. Joseph County, Indiana, and which further provides <br />services to victims of certain crimes; and <br />WHEREAS, the SVU presently combines the expertise of highly skilled and trained law <br />enforcement officers from the St. Joseph County Police Department, the SBPD, and the <br />Mishawaka Police Department, as well as the technical and support services of Indiana University <br />South Bend and the Notre Dame Security Police Department, to among other things investigate, <br />provide services to victims, gather and report data, and share information with the SBPD <br />concerning crimes involving child abuse and sex crimes and other connected crimes in St. Joseph <br />County; and <br />WHEREAS, Indiana Code 36-1-7, the Interlocal Cooperation Act, authorizes one or more <br />governmental entities to exercise, jointly or by one entity on behalf of others, powers that may be <br />exercised by such units severally; and <br />WHEREAS, the Indiana Cities of South Bend and Mishawaka, along with the County of <br />St. Joseph share a combined interest in entering into an Interlocal Agreement so that by working <br />cooperatively, they may efficiently and effectively investigate, provide services to victims, gather <br />and report data, and share information concerning crimes of child abuse and sex crimes and other <br />connected crimes in St. Joseph County. <br />WHEREAS, pursuant to IC 36-1-7, the City will cooperatively assist the SVU operation <br />by providing South Bend Police Department officers to serve as Investigators, by providing each <br />of these Investigators with a vehicle and requisite equipment pursuant to the Interlocal Agreement, <br />and by providing funds to pay for the cost and expenses of three additional Investigators of <br />approximately $99,055 per officer annually, for an annual total of about $297,165. The Prosecutor <br />of St. Joseph County will provide for the facilities needed for the SVU operations, and the cost of <br />the SVU command staff, among other things; and
