Identifies the Authorized Representative for the new owner or operator in accordance with <br />Part IV (B)(15) of this permit, including telephone number and email address; <br />iii. States that the new owner and/or operator has no immediate intent to change the facility’s <br />operations and processes; <br />iv. Identifies the specific date on which the transfer is to occur; and <br />v. Acknowledges full responsibility for complying with the existing individual wastewater <br />discharge permit. <br /> <br />b. Failure to provide advance notice of a transfer renders this permit void as of the date of transfer. <br /> <br />12. Reopening Clause <br /> <br />a. This permit shall be modified, or alternatively, revoked and reissued, to comply with any applicable <br />effluent limitation or standard issued or approved under section 307(b) of the Clean Water Act if <br />the effluent limitation or standard so issued or approved: <br /> <br />i. Contains different conditions or is otherwise more stringent than any effluent limitation in <br />the permit; or <br />ii. Controls any pollutant not limited in the permit. <br /> <br />b. The permit, as modified or reissued under this paragraph, shall also contain any other requirements <br />of the Clean Water Act when applicable. <br /> <br />13. Records Retention <br /> <br />a. Permittees shall retain, and make available for inspection and copying, all records of information <br />obtained pursuant to any monitoring activities required by this permit, any additional records of <br />information obtained pursuant to monitoring activities undertaken by the permittee independent of <br />such requirements, and documentation associated with Best Management Practices established <br />under Section 17-8 of the South Bend Municipal Code. Records shall include the date, exact place, <br />method, and time of sampling, and the name of the person(s) taking the samples; the dates analyses <br />were performed; who performed the analyses; the analytical techniques or methods used; any <br />information used to demonstrate that the analysis was performed in accordance with methods <br />approved in 40 CFR Part 136; and the results of such analyses. These records shall remain available <br />for a period of at least three (3) years. This period shall be automatically extended for the duration <br />of any litigation concerning the permittee or the City, or where the permittee has been specifically <br />notified of a longer retention period by the Director. <br /> <br />14. Federal and State Pretreatment Requirements <br /> <br />a. Compliance with this wastewater discharge permit does not relieve the permittee of responsibility <br />for compliance with all applicable Federal and State Pretreatment Standards, including those which <br />become effective during the term of this wastewater discharge permit. <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br />
