The plan shall also include the certification statement found in Part III (A) (4) signed by <br />the Authorized Representative [see Part IV (B) (15)] <br /> <br />2. The permittee shall orally notify the Control Authority immediately upon the occurrence of a slug or <br />accidental discharge of prohibited substances. The notification shall include location of discharge, date <br />and time of occurrence, type of waste, concentration and volume, and corrective action. Immediate <br />notification shall be verbal followed by a written verification within five (5) days of the incident. <br /> <br />3. The permittee shall notify the Control Authority immediately if any changes occur at the facility that <br />affect the potential for a slug or accidental discharge. Additionally, the permittee shall submit a revised <br />plan that reflects those changes. <br /> <br />4. Once submitted, the Accidental Discharge/Slug Control Plan shall be deemed an enforceable part of the <br />permit and shall be implemented as written. Any deviation from the Accidental Discharge/Slug Control <br />Plan shall constitute a permit violation. <br /> <br /> <br />F. Certified Operator Requirement: <br /> <br />1. As required by Section 17-10 (o)(4)(b) of the South Bend Municipal Code: <br /> <br />Tri-Pac Inc. <br />3701 Progress Drive <br />South Bend IN 46628 <br /> <br />Tri-Pac, Inc shall be required to have a Certified Industrial Wastewater Operator of the State of Indiana <br />with the minimum classification listed below, sign all periodic compliance reports, 90 day compliance <br />status reports, and all compliance schedule reports, indicating whether Pretreatment Standards are being <br />met on a consistent basis, and if not whether additional operation and maintenance and/or additional <br />pretreatment is required to meet the Pretreatment Standards and Requirements. <br /> <br />The Certified Operator shall sign one of the following statements: <br /> <br />“Pretreatment Standards and Requirements are being met on a consistent basis.” <br /> <br />Or <br /> <br />“Pretreatment Standards and Requirements are not being met on a consistent basis. Additional <br />operation and maintenance and/or additional pretreatment is required to meet the Pretreatment <br />Standards and Requirements.” <br /> <br />Industrial Certified Operator Classification: B <br /> <br />2. This permit holder shall have a certified operator, with the minimum classification listed above, sign all <br />periodic compliance reports, 90 day compliance status reports, and all compliance schedule reports. <br /> <br />3. If a certified operator is not signing permittee’s user reports, a $500.00 fine will be assessed followed by <br />a $500.00 fine for every user report submitted, until the certified operator requirement is met. <br /> <br />4. If laboratory analytical data was not reported on the PCR, the requirement for the PCR to be signed by a <br />Certified Industrial Wastewater Operator is not required, unless otherwise indicated by the Director.
