ORDINANCE NO. ~ b ~ ~ ~ ~ <br />AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, <br />INDIANA, APPROVING MONTHLY PARKING RATES FOR PARKING GARAGES <br />OPERATED BY THE BOARD OF PUBLIC WORKS OF THE <br />CITY OF SOUTH BEND, INDIANA <br />STATEMENT OF PURPOSE AND INTENT <br />Indiana Code Section 36-9-11-7 authorizes the Board of Public Works to fix reasonable <br />rates and charges to be collected for parking vehicles in parking facilities owned and operated by <br />the City and for other use of those parking facilities so as to promote the maximum use of the <br />facilities by the public in a safe, orderly, and efficient manner. Such rates fixed by the Board of <br />Public Works are subject to the approval of the Common Council. The Board of Public Works <br />adopted a Resolution on May 27, 2008 which sets out rates for vehicles parked at City operated <br />garages, a copy of which is attached hereto and incorporated herein. These rates are reasonable <br />and are designed to bring in revenue sufficient to cover the cost of maintaining and operating the <br />parking facilities. <br />NOW, THEREFORE, BE I'I' ORDAINED BY THE COMMON COUNCIL OF THE <br />CITY OF SOUTH BEND, INDIANA as follows: <br />Section I. The following monthly parking rates shall be charged for vehicles parked at <br />City operated garages: <br />Old Rate New Rate <br />A. Monthly Rate -Standard Parking per vehicle in $40.00 $45.00 <br />area located above gates. <br />B. Monthly Rate -Premium Parking per vehicle $50.00 $55.00 <br />in areas marked as RESERVED. <br />Section II. The option to issue or renew agreements for parking in City-owned and <br />operated garages lies with the sole discretion of the Board of Public Works or its designee. <br />Unless otherwise designated, parking spaces shall be allocated on a first come, first served basis. <br />Should the demand for parking exceed supply, priority for parking spaces shall be given to those <br />who pay the monthly rate as long as payment is timely and current. <br />Section III. At this time the Board of Public Works has designated the corporation <br />AMPCO to operate and manage all City parking garages. AMPCO, or any successor to AMPCO <br />designated by the Board of Works, through its agents and employees, shall have full power and <br />authority within the confines of City operated parking facilities to enforce the rules and <br />
