REGULAR MEETING DECEMBER 11, 2012 391 <br />WHEREAS, it has been determined by the Board of Public Works that the following property <br />is unfit for the purpose for which it was intended and is no longer needed by the City of South <br />Bend: <br />VARIOUS -EQUIPMENT FROM THE FIRE DEPARTMENT AND <br />THE MORRIS PERFORMING ARTS CENTER <br />(SEE ATTACHED LIST) <br />WHEREAS, Indiana Code 5 -22 -22 permits and establishes procedure for disposal of personal <br />property which is unfit for the purpose for which it was intended and which is no longer needed <br />by the City. <br />NOW, THEREFORE, BE IT RESOLVED by the Board of Public Works of the City of South <br />Bend that the items listed above are no longer needed by the City and/or are unfit for the purpose <br />for which they were intended and have an estimated combined value of less than five thousand <br />dollars ($5,000.00). <br />BE IT FURTHER RESOLVED that said items may be transferred or sold at public auction or <br />private sale, without advertising. Martin, Clerk <br />ADOPT RESOLUTION NO. 73 -2012 — A RESOLUTION OF THE BOARD OF PUBLIC <br />WORKS OF THE CITY OF SOUTH BEND, INDIANA ESTABLISHING POLICY FOR <br />RESPONSIBLE BIDDING IN PUBLIC WORKS PROJECTS <br />Ms. Greene noted this resolution is a result of a work in progress over the last year due to an <br />Ordinance of the Common Council. She stated she met with the Trade Unions, MACAIF, and <br />Council members. They came up with a policy that would apply to Public Work's projects over <br />$150,000.00. She noted the Board is allowed to set their own policies and procedures and this <br />one captures the requirements of State law on how to award a bid and additional language that <br />would allow the Board to audit contractors. She noted this doesn't change many requirements in <br />place but allows the Board to periodically confirm that contractors are compliant with wage <br />rates. She stated this adds a level of responsibility to contractors doing business with the City; <br />allows the Board to do random audits of contractors doing business with the City; and is <br />consistent with the duties and policies of State law. Mr. James Gardner, Local No. 150, stated he <br />sent the resolution to the Unions and they are all on board with the policies. Upon a motion made <br />by Ms. Roos, seconded by Mr. Inks and carried, the following Resolution was adopted by the <br />Board of Public Works: <br />RESOLUTION NO. 73-2012 <br />A RESOLUTION OF THE BOARD OF PUBLIC WORKS OF <br />THE CITY OF SOUTH BEND, INDIANA ESTABLISHING POLICY FOR <br />RESPONSIBLE BIDDING IN PUBLIC WORKS PROJECTS <br />WHEREAS, pursuant to I.C. §36 -1 -12 et seq., as amended from time -to- time, the City of <br />South Bend, Indiana Board of Public Works ( "Board ") has authority over construction of <br />"Public works ", as defined by I.C. § 36- 1 -12 -2; and <br />WHEREAS, the Board's duties include, but are not limited to, oversight of the public <br />bidding process as well as the award of public contracts associated with public works projects; <br />and <br />
