1 Bill No. 130-21 Ordinance No. __________ -21 AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, AMENDING CHAPTER 20, ARTICLE 8 OF THE SOUTH BEND MUNICIPAL CODE TO ADDRESS TRUCK ROUTES THROUGH THE CITY AND THE RULES AND REGULATIONS OF TRUCKS AND LARGE VEHICLES --------------------------------------------------------------------------------------------------------------------- STATEMENT OF PURPOSE AND INTENT --------------------------------------------------------------------------------------------------------------------- Chapter 20, Article 8 of the South Bend Municipal Code (the Code) involves rules and regulations for the operation of trucks within the City. It was enacted in 1986 and slightly amended in 1988. The purpose of this ordinance is to adjust for substantially changed conditions and circumstances since 1988, including an increase in truck traffic, the 2016 conversion of downtown streets to two-way, and the addition of roundabouts. This ordinance makes such adjustments by adding more truck routes, addressing truck marking and lighting, and regulating different weights and contents of truck loads through a permit process, among other things. This ordinance promotes the public health, safety, and economy of South Bend and is in the best interest of its citizens. Now, Therefore, Be It Ordained by the Common Council of the City of South Bend, Indiana as follows: Section I. Chapter 20, Article 8 of the South Bend Municipal Code shall be amended to read as follows: Sec. 20-106. – Definitions a) As used in this article Article, the following terms shall mean: (1) Truck, as the term is used in this section, is a vehicle having three (3) axles or a vehicle over ten thousand [pounds] (10,000) gross vehicle weight, and includes semi-trailer trucks and either the tractor pulling the same, or the trailer itself. Truck includes every self- propelled commercial vehicle designed, used or maintained for the commercial transport of goods or property. (2) City Block, as the term is used in this section, is that portion of a public street bounded by the highest and lowest numbers within any sequence of 100s, such as 200 to 299, 300 to 399, etc.
