1 <br />Bill No. 130-21 <br />Ordinance No. __________ -21 <br />AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, <br />INDIANA, AMENDING CHAPTER 20, ARTICLE 8 OF THE SOUTH BEND <br />MUNICIPAL CODE TO ADDRESS TRUCK ROUTES THROUGH THE CITY AND THE <br />RULES AND REGULATIONS OF TRUCKS AND LARGE VEHICLES <br />--------------------------------------------------------------------------------------------------------------------- <br />STATEMENT OF PURPOSE AND INTENT <br />--------------------------------------------------------------------------------------------------------------------- <br />Chapter 20, Article 8 of the South Bend Municipal Code (the Code) involves rules and <br />regulations for the operation of trucks within the City. It was enacted in 1986 and slightly <br />amended in 1988. <br />The purpose of this ordinance is to adjust for substantially changed conditions and <br />circumstances since 1988, including an increase in truck traffic, the 2016 conversion of <br />downtown streets to two-way, and the addition of roundabouts. This ordinance makes such <br />adjustments by adding more truck routes, addressing truck marking and lighting, and regulating <br />different weights and contents of truck loads through a permit process, among other things. <br />This ordinance promotes the public health, safety, and economy of South Bend and is in <br />the best interest of its citizens. <br />Now, Therefore, Be It Ordained by the Common Council of the City of South Bend, <br />Indiana as follows: <br />Section I. Chapter 20, Article 8 of the South Bend Municipal Code shall be amended to <br />read as follows: <br />Sec. 20-106. – Definitions <br />a) As used in this article Article, the following terms shall mean: <br />(1) Truck, as the term is used in this section, is a vehicle having three (3) axles or a <br />vehicle over ten thousand [pounds] (10,000) gross vehicle weight, and includes semi-trailer <br />trucks and either the tractor pulling the same, or the trailer itself. Truck includes every self- <br />propelled commercial vehicle designed, used or maintained for the commercial transport of <br />goods or property. <br />(2) City Block, as the term is used in this section, is that portion of a public street bounded <br />by the highest and lowest numbers within any sequence of 100s, such as 200 to 299, 300 to 399, <br />etc.
