. r <br /> Council Member Coleman made a motion, seconded by Council Member Kelly that Bill <br /> No. 38-04 be recommended favorably to Council. The motion passed. <br /> Council Member Kuspa then called for a presentation on Bill No. 36-04 which would <br /> annex and bring into the city limits property in German Township commonly known as 23977 <br /> Brick Road. <br /> Mr. Magliozzi noted that this Bill had its public hearing on July 12th along with its fiscal <br /> plan and tonight it will have a 3rd reading only. Therefore no action by the Committee is <br /> necessary at this time. <br /> Council Member Kuspa then called for a presentation on Bill No. 04-81 which would <br /> adopt a written fiscal plan and establish a policy for the provision of services to an annexation <br /> area in German Township commonly known as the Steve and Jean Cooreman Annexation Area. <br /> Council Member Kuspa also asked for a presentation on its companion bill, namely Substitute <br /> Bill No. 28-04 which would annex and being into the city limits and amend the zoning ordinance <br /> for 21300 block of Cleveland Road and 52804 Lynnewood Avenue located in German <br /> Township. <br /> Council Member Deiter disclosed that he recently had a dealing with the petitioner,Mr. <br /> Cooreman, however that transaction has nothing to do with the proposed Bills pending before <br /> the Council. <br /> Larry Magliozzi reviewed the proposed fiscal plan which received a favorable <br /> recommendation from the Board of Public Works and the Board of Public Safety on this area of <br /> approximately five(5)acres. He also provided a separate 2-page document highlighting seven <br /> (7)areas which he noted, in response to a question from Council Member Coleman,that it was <br /> not part of the written fiscal plan(copy attached). <br /> Andy Videkovich of the Area Plan staff noted that at the May 18, 2004 meeting of the <br /> Area Plan Commission Substitute Bill No. 28-04 had a public hearing. The Area Plan <br /> Commission sends the Bill to the Council with a favorable recommendation. <br /> Michael Danch of Danch,Harner&Associates,Inc.,with offices at 2422 Viridian Drive <br /> in South Bend made the presentation. He noted that the area in question is in the northeast <br /> corner of the development and he provided copies of a preliminary site plan(copy attached). He <br /> and Mr. Steve Cooreman then provided a 13-page document to the committee which contained: <br /> a colored map of the area in question depicting other commercial uses in the area; pictures of the <br /> Niles Kentucky Fired Chicken Store; a letter dated July 15,2004 to the Council from William F. <br /> Alford,Jr. Corporate President of KFC of Niles,Michigan which stated that the lighting would <br /> go on at dusk and go off at 10:00 pm and would be directed toward the building. That letter also <br /> indicated that trash pick-up would take place 3-4 times a week and that the trash containers are <br /> enclosed and not visible to the public. The packet contained a letter dated May 19, 2004 from <br /> Robert W. Sante,Executive Director of the Area Plan Commission noting that Karl King and <br /> Roland Kelly made the motions at the May 18,2004 Area Plan Commission meeting <br /> recommended favorable action on the proposed rezoning from"0"Office and"R"Residential <br /> to"CB" Community Business,noting that the "use and zoning proposed is appropriate for this <br /> location given the other business and office uses that are located along Cleveland Road".
