272, Saturday August 26th The Board met in regular session at 10 A. 14. Mr..Papezynski absent. Hearing on Assessment Roll and Final estimate for the Hill street Brick Pavement deferred until Tuesday August 29th, 1905, at 10 A. M. Hearing given on Assessment Roll and Final estimate for the Brick Pavement on Elm street from Washington street to the City Cemetery. Under Improvement Res1lution No. 247. No remonstrators appeared and -no remonstrances were filed. The•Board therefore find that the property assessed in said rolls filed August 2nd, 1905, is benefitted in the amount of assessments as shown on sair.roll and the Board find that the assessment roll filed August 2nd,1905, and the final estimate allowed August 2nd, 1905, should be and the same is hereby in all things ratified, confirmed and approved. Indiana Railway Company's Contract. This contract, made ane executed in duplicate on this 26th day of August, 1905, by and between the City of South Bend, Indiana, by and through its duly authorized Board of Public Works, duly authorized in the premises, and the Indiana Railwaymcorporation organized under the laws of the State of Indiana. WITNESSETH: That � (for convenience the said Indiana Railway Company shall hereinafter be known and designated In this contract by the word "Company") Section 1.. The said.Company is hereby authorized to construct and extend its tracks with all necesz�ary side-tracks, turn -outs, Y's, switches, and equipments upon the following streets in the City of South Bend, Indiana, to -wit: Beginning at the North line of the junction of Calvert and Miami : streets, thence running North on Miami street to Indiana Avenue, thence West on Indiana Avenue to Marietta street, thence North on Marietta street to Broadway, thence test on Broadway to Michigan street; also, beginning at the junction of Fellows and Broadway, tremce North on Fellows street to Vistula avenue. Section 2. It is hereby agreed between the parties that the said Company shall.:' complete.the said extension beginning at the junction of `Calvert and -Miami streets and ending at the junction of Broadway and Michigan streets by the first day of January, 1906, and that the said Company shall complete the said extension beginning at the junction of Fellows and Broadway street and ending at the junction of- Fellows.street and Vistula avenue by the First day of January, 1907.. Section 3. The permission and authority herein granted is subject to all of the conditions, restrictions, limitations and regulations as contained and expressed in Ordinance Number 696 adopted by the Common Council of the City of South Bend, Indiana, Jarn:ary l9th, 19$5, and the same is hereby made a part of this contract. - IN WITNESS WHEREOF the parties have caused these presents to be executed by the Board of Public Works of the City of South Bend, acting on behalf of the City, and the Indiana Railway Company, by its"Tresident and Secretary.
