® Drug Test means a test conducted for controlled <br />substances. <br />Employee means an Employee of a Company, or of a <br />Contractor/Employer Participant, who is a member <br />of BCRC. <br />Employee Assistance Program (EAP) Counselor <br />means a Masters -level professional with an education in <br />psychology, social work, counseling, etc. with knowledge <br />of and clinical experience in diagnosis and treatment <br />of alcohol and controlled substance related disorders. <br />The EAP will assess and make recommendations <br />concerning education, treatment, Observed Follow -Up <br />Testing and aftercare. <br />Employer means a Company, or a Contractor/Employer <br />Participant, who is a member of BCRC. <br />Evidential Breath Testing Device (EBT) means a <br />device approved by NHTSA for the evidential testing of <br />breath at the .02 and .04 alcohol concentrations, placed <br />on NHTSAs Conforming Products List (CPL) for <br />"Evidential Breath Measurement Devices" and identified <br />on the CPL as conforming with the model specifications <br />available from NHTSAs Traffic Safety Program. <br />First Occurrence Clause means if an Employee does <br />not report for a random test, and it is the first time the <br />Employee has failed to report, the Third Party <br />Administrator (TPA or BCRC) may allow the <br />Employee to take the test without reporting to the <br />EAP for further review. Employees may utilize this <br />clause only one time. <br />Gas Chromatography/Mass Spectrometry <br />Confirmation (GC/MS) is a state-of-the-art drug <br />testing technology, providing a fingerprint of the <br />detected drug. <br />10 <br />
