Observation and testingfor Reasonable Suspicion for controlled substances can occur at anytime <br />the employee is on duty. An employee who is suspected of controlled substance use must be <br />immediately removed from their position and is required to undergo testing. <br />Observation and testing for Reasonable Suspicion for alcohol can occur only before, during, or <br />just after the employee's job function, or at any time that the employee is in readiness to perform <br />a job function. An employee who is suspected of alcohol misuse must be immediately removed <br />from their job function and is required to undergo testing. A company official will escort the <br />employee to the collection site. <br />The employee cannot return to duty until an alcohol test has been conducted with a BAC less than <br />0.020. <br />If an alcohol test is not conducted within two (2) hours, the reasons the test was not conducted <br />must be documented. If an alcohol test is not conducted within eight (8) hours, any attempts to <br />conduct an alcohol test will cease and the supervisor/DER shall document the reasons for not <br />conducting the t est. If no alcohol test is conducted, the employee cannot perform their job <br />function until twenty-four (24) hours have elapsed following the original determination of <br />Reasonable Suspicion of alcohol use. <br />An employee who is tested for controlled substances under this Reasonable Suspicion will be <br />compensated if the test results are negative and will not be compensated for time missed from <br />work if the test result is positive, adulterated or substituted. <br />Examples of Reasonable Suspicion include, but are not limited to, the following: <br />Physical signs and symptoms consistent with prohibited substance use or alcohol misuse. <br />Evidence of the manufacture, distribution, dispensing, possession, or use of controlled <br />substances, drugs, alcohol, or other prohibited substances. <br />Occurrence of a serious or potentially serious accident that may have been caused by prohibited <br />substance abuse or alcohol misuse. <br />Physical contact (meaning fights), assaults, and flagrant disregard or violations of established <br />safety, security, or other operating procedures. <br />Post - Accident Testing Under TGB UNLIMITED, INC. <br />OBA S/T BANCROFT ELECTRIC's Authority <br />All employees of TGB UNLIMITED, INC. DBA S/T BANCROFT ELECTRIC are required to undergo <br />urine drug testing and breath alcohol testing, if they are involved in an accident with a vehicle <br />owned or leased by TGB UNLIMITED, INC. DBA S/T BANCROFT ELECTRIC, and if one or all of the <br />following conditions are met: <br />The accident resulted in a human fatality <br />13 <br />
