<br />INDIANA, AMENDING THE ZONING ORDINANCE FOR PROPERTY LOCATED AT
<br />THE SOUTHWEST CORNER OF ADAMS ROAD AND ST. JOSEPH VALLEY
<br />PARKWAY, COUNCILMANIC DISTRICT NO. 1 IN THE CITY OF SOUTH BEND,
<br />INDIANA

<br />STATEMENT OF PURPOSE AND INTENT
<br />To build a Utility Service Center for AEP
<br />______________________________________________________________________________
<br />Petitioners desire to rezone the property from NC Neighborhood Center District to I
<br />Industrial District.
<br />NOW, THEREFORE, BE IT ORDAINED by the Common Council of the City of South Bend,
<br />Indiana, as follows:
<br />SECTION I. Ordinance No. 10689-19, which ordinance is commonly known as the
<br />Zoning Ordinance of the City of South Bend, Indiana, be and the same hereby amended in order
<br />that the zoning classification of the following described real estate in the City of South Bend, St.
<br />Joseph County, State of Indiana:
<br />Situate in the State of Indiana, County of St. Joseph, Township of German, City of South
<br />Bend, being a part of the Northeast Quarter of Section 18, Township 38 North, Range 2
<br />East of the Second Principal Meridian, also being a part of Lot 1 as shown on the plat of
<br />Farm House Minor Subdivision as recorded in Document Number 9700350 in the St.
<br />Joseph County Recorder’s Office, and being more particularly described as follows:
<br />Commencing at a Harrison Type Monument Found at the Northeast Corner of the
<br />Northeast Quarter of Section 18, said monument being along the Centerline of the Right-
<br />of-Way of Adams Road; Thence, coincident with the North line of said Section 18 and
<br />along the centerline of said Adams Road, North 89° 52’ 59” West, a distance of 1,354.52
<br />feet to a point, an Iron Pin Found bears South 00° 07’ 04” West, a distance of 36.70 feet;
<br />Thence, leaving the North line of said Section 18 and the centerline of said Adams Road,
<br />South 00° 07’ 04” West, a distance of 77.39 feet to an Iron Pin Set, said Iron Pin being a
<br />Northeasterly corner of a 32.17 acre tract owned now or previously by Irish Rentals, LLC
<br />(State Parcel ID 71-03-17-301-009.000-009) as recorded in Document Number 2020-
<br />15586 in the St. Joseph County Recorder’s Office, said Iron Pin also being the Southeast
<br />corner of a 0.39 acre tract owned now or previously by Waggoner Farms Development,
<br />LP (State Parcel ID 71-03-17-301-013.000-009) as recorded in Document Number
<br />1534323 in the St. Joseph County Recorder’s Office, said Iron Pin also being the
<br />Southwest corner of a 1.87 acre tract owned now or previously by Waggoner Farms
<br />Development, LP (State Parcel ID 71-03-18-226-012.000-009), said Iron Pin also being
<br />the TRUE PLACE OF BEGINNING of the parcel herein described; Thence, coincident
<br />with a Southerly line of said 1.87 acre tract, South 80° 10’ 35” East, a distance of 434.48
<br />feet to an Iron Pin Set, said Iron Pin being a corner of said 1.87 acre tract; Thence,
<br />coincident with a Westerly line of said 1.87 acre tract, South 5° 30’ 33” West, a distance
<br />of 298.52 feet to an Iron Pin Set, said Iron Pin being the Southern corner of said 1.87 acre
<br />tract, said Iron Pin also being a Northeasterly corner of said 32.17 acre tract; said Iron Pin
<br />also being the Northeastern corner of a 0.44 acre tract owned now or previously by
<br />Waggoner Farms Development, LP (State Parcel ID 71-03-17-301-013.000-009);
<br />Thence, coincident with a Northerly line of said 32.17 acre tract, North 89° 55’ 05” West,
<br />a distance of 400.21 feet to an Iron Pin found, said Iron Pin being a Northeasterly corner
<br />of said 32.17 acre tract; Thence, coincident with a Northeasterly line of said 32.17 acre
<br />tract, North 00° 07’ 04” East, a distance of 370.70 feet to the TRUE PLACE OF
<br />BEGINNING. CONTAINING 3.187 Acres, more or less, as surveyed all of which
<br />contained within the Northeast Quarter of Section 18.
