The area to be vacated is more <br /> particularly described in the legal description attached hereto as EXHIBIT A and its location <br /> depicted on the attached EXHIBIT B. <br /> This request is to vacate excess un-needed public right-of-way of Niles Avenue for use by the <br /> adjacent property owner for future residential and commercial redevelopment. <br /> Also, the City of South Bend Board of Public Works issued their favorable recommendation for <br /> the vacation of this property at their December 11, 2012, meeting.
