Approving and adopting the East Bank Village Master Plan - Phase I

WHEREAS, Section 16(b) of the Act prohibits the Commission from proceeding until the Plan Commission Order is approved by the legislative body of the City; and WHEREAS, the Common Council of the City (the "Common Council") is the legislative body of the City and now desires to approve the Plan Commission Order in order to permit the Commission to proceed with the acquisition and redevelopment of the Area; and WHEREAS, the East Bank Village Master Plan-Phase 1, which, is attached hereto and incorporated herein, contains all the elements necessary to strategically guide development in the East Bank of the City's downtown area, and is appropriate and in the best interest of the City and its citizens. NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of South Bend, Indiana as follows: SECTION I: The Plan Commission Order attached hereto is hereby approved, ratified and confirmed in all respects. SECTION II: That the East Bank Village Master Plan-Phase 1, a true and complete copy of which is attached hereto and incorporated herein shall be and hereby is approved. SECTION III: That any use of Eminent Domain in the East Bank Village area will be approved by the South Bend Common Council.
