Zoning and Annexation Committee
The February 23, 2004 meeting of the Zoning and Annexation Committee was called to
order by its Chairperson, Council Member Ervin Kuspa at 3:30 p.m. in the Council Informal
Meeting Room.
Persons in attendance included: Council Members Dieter, Kelly,Piizzello, Varner,
Kuspa, White, Coleman, and Kirsits;Fire Chief Luther Taylor,Assistant Chief Rick Switalski,
Tom Skarbek, Jeff Myers Police Chief Tom Fautz, Terry Bland of the South Bend Tribune, and
Kathleen Cekanski-Farrand, Council Attorney.
Council Member Kuspa noted that members of the Committee who were present included
Council Members Kelly,Puzzello and himself
Council Member Kuspa stated that the Council received a memo dated February 9, 2004
from Dave Dickey,Development Director for Sterling Development,LLC requesting that Bill
No. 4-04 be withdrawn from further consideration.
Following discussion, Council Member Kelly made a motion, seconded by Council
Member Puzzello that Bill No. 4-04 be recommended to be struck from the Council's agenda
this evening. The motion passed.
Under miscellaneous business, the Council Attorney noted that this evening Bill No.
13-04 is set for 1st reading. This Bill addresses 508-536 Crescent Avenue which was recently
addressed in a separate ordinance for Madison Center. A scrivener's error has been found in the
legal description. Following discussion with the petitioner's attorney and the staff of the Area
Plan Commission, it was determined that this Bill could be handled directly by the Council at its
meeting of March 8th,rather than going to the Area Plan Commission, since it addresses a
scrivener's error only.
There being no further business to come before the Committee, Council Member Kuspa
adjourned the meeting at 3: 34 p.m.
Respectfully submitted,
Council Member Ervin Kuspa, Chairperson
Zoning and Annexation Committee
KCF:kmf
Attachments
