Michiana Contracting Statement Regarding <br />Drug and Alcohol Use in the Workplace <br />Michiana Contracting Inc. premises or workplace locations may be required to complete <br />a "prescription drug: form, and Michiana Contracting may, as it deems appropriate, <br />determine if the drug produces hazardous effects. <br />Michiana Contracting has the right in its discretion to report for the use, possession or <br />distribution of any substance named in the first paragraph of this policy to law <br />enforcement officials and to turn over to the custody of law enforcement officials any <br />such substances or company property. <br />Drug Testing Program <br />In compliance with Indiana Code 4-13-18-6, Michiana Contracting's Drug Testing <br />Program will include: <br />1. Each employee will be subject to a drug test at least one (1) time each year. <br />2. Employees will be tested randomly. At least two percent (2%) of Michiana <br />Contracting's employees will be randomly selected each month for testing. <br />3. Testing will include and at least a five (5) drug panel that tests the following: <br />• Amphetamines <br />• Cocaine <br />• Opiates (2000 ng/ml) <br />• PCP <br />■ THC <br />This program will impose progressive discipline on an employee who fails a drug test as <br />follows: <br />After the first positive test, an employee must be: <br />a) suspended from work for thirty (30) days; <br />b) directed to a program of treatment or rehabilitation; and <br />c) subject to unannounced drug testing for one (1) year, beginning the <br />day the employee returns to work. <br />After the second positive test, an employee must be: <br />a) Suspended from work for ninety days; <br />b) Directed to a program of treatment or rehabilitation through Michiana <br />Contracting's EAP program, and <br />c) Subject to unannounced drug testing for one (1) year, beginning the <br />day the employee returns to work. <br />After a third positive test, an employee must be: <br />a) suspended from work for one (1) year; <br />b) directed to a program of treatment or rehabilitation through Michiana <br />Contracting's EAP program; and <br />c) subject to unannounced drug testing for one (1) year beginning the day <br />the employee returns to work. <br />This program may require dismissal of the employee after any positive drug test <br />or other discipline more severe than is described in this subdivision. <br />
