This violation alleged that we had not trained the employee as required. We argued that the employee had received the training and had performed the same job for over 3 months and that there was another issue with the employee that day that caused the accident. This violation and fine were lowered to other than serious after the details were explained to MIOSHA.Employee in question was released from employment and company retrained all field supervisors to better recognize employee under the influence.Other 2,400.00$ There was a question about us using a forming system other than the way described. We were able to show on appeal that the reason were using the system that way was because it was the only way to use it. The violation and fine were lowered..Work with forming suppliers to make sure forming system use is signed off on before use.5/22/2018 Serious 1,200.00$ Rebar sticking up did not have a rebar cap on it.Rebar caps were put on all exposed rebarSerious 1,500.00$ This was a bridge deck re-work. The areas on the bridge approaches were labeled a fall hazard (by MIOSHA during the inspection) and since we had equipment stored near the edge we were cited.Temporary Hand rails were installed around bridge approachesOther -$ Welder did not have plastic/rubber caps at the point of connections for the leads. Employee were instructed on GFCI pigtail use.Other -$ Employee did not have his fork lift operator card on him while operating a sky track. He was trained and was issued a card but forgot to put it into his wallet that day.Employee was instructed to keep his card on him at all time. 2/14/2017 Other -$ Confined space that we were not entering did not have a sign calling out that it was a confined space. Actually our sub-contractor was in the space and removed our signage. This was upheld on appeal.Since this was existing we made up a temporary sign and taped it on the hatch11/1/2016 Other -$ Existing hatch in an existing building we were working in did not have a label on it calling it out as a hatch. This was an existing hatch that had a barricade around it. Since this was existing we made up a temporary sign and taped it on the hatchOther -$ Permit Confined space that we were not entering did not have a sign calling out that it was a confined space. Even though we followed all procedures when we entered the space previously. But they cited us for the space even though we were done with the space and were not going in it again.We made up a sign and placed it on it calling it out as a confined space.
