Martin, Clerk <br />ADOPT RESOLUTION NO. 79 -2012 — A RESOLUTION OF THE SOUTH BEND BOARD <br />OF PUBLIC WORKS ON DISPOSAL OF UNFIT AND /OR OBSOLETE PROPERTY <br />Upon a motion made by Mr. Mecham, seconded by Mr. Inks and carried, the following <br />Resolution was adopted by the Board of Public Works: <br />RESOLUTION NO. 79 -2012 <br />A RESOLUTION OF THE SOUTH BEND BOARD OF PUBLIC WORKS <br />ON DISPOSAL OF UNFIT AND /OR OBSOLETE PROPERTY <br />WHEREAS, it has been determined by the Board of Public Works that the following property <br />is unfit for the purpose for which it was intended and is no longer needed by the City of South <br />Bend: <br />COMMUNICATIONS AND WATER WORKS EQUIPMENT <br />(SEE ATTACHED LIST <br />WHEREAS, Indiana Code 5 -22 -22 permits and establishes procedure for disposal of <br />personal property which is unfit for the purpose for which it was intended and which is no longer <br />needed by the City. <br />NOW, THEREFORE, BE IT RESOLVED by the Board of Public Works of the City of <br />South Bend that the items listed above are no longer needed by the City and /or are unfit for the <br />purpose for which they were intended and have an estimated combined value of less than five <br />thousand dollars ($5,000.00). <br />BE IT FURTHER RESOLVED that said items may be transferred or sold at public <br />auction or private sale, without advertising. Martin, Clerk <br />ADOPT RESOLUTION NO. 80 -2012 — A RESOLUTION OF THE SOUTH BEND BOARD <br />OF PUBLIC WORKS APPROVING THE TRANSFER OF REAL PROPERTY FROM THE <br />SOUTH BEND REDEVELOPMENT COMMISSION <br />Ms. Greene stated she has three issues with this transfer of property; first, has it been confirmed <br />that the properties are in the name of the Redevelopment Commission; second, are the empty lots <br />going to be put into use; and third, if not, are there funds allocated for the maintenance of the <br />properties. Mr. Inks stated Community Investment has been going through identifying properties <br />that should not be in their name, some of which they may be paying for snow removal. Ms. <br />Greene stated if the City doesn't have the funds to maintain the lots; that could be problematic. <br />Mr. Inks stated some of the properties are maintained by Downtown South Bend and some by <br />the South Bend Park Department, and they will continue to maintain them. He noted they just <br />should not be listed as property of the Redevelopment Commission. Upon a motion made by Mr. <br />
