Qommttti* *oat <br /> Zoning alb Zun cattou ctommttt u <br /> The May 27, 2003 Zoning and Annexation Committee was called to order by its Chairperson, <br /> Council Member Ervin Kuspa at 4:16 p.m. in the Council Informal Meeting Room. <br /> Persons in attendance included Council Members Pfeifer, Kelly, Kuspa, White, Varner, and <br /> King; Building Commissioner Don Fozo, Jeff Myers, Isabel Gonzalez, Bill Schalliol, Andy <br /> Viderovich, Terry Bland of the goattrl Kekt'llp 'l tb'lttlt and Council Attorney Kathleen <br /> Cekanski-Farrand. <br /> Council Member Kuspa noted that the Zoning and Annexation Committee members present include <br /> Council Members Varner,Coleman and himself. <br /> Council Member Kuspa then called for a presentation on Bill No. 26-03 which would amend <br /> Chapter 21, Article 2 of the South Bend Municipal Code dealing with use district regulations by <br /> adding a new zoning district to be known as"CB"Community Business District. <br /> Bill Schalliol of Community and Economic Development made the presentation. He stated that if <br /> approved it would promoted high value, high intensity developments particularly on the southside <br /> of the city. <br /> Council Member King noted that the ordinance would provide a terrific addition as a zoning district <br /> to avoid the "sea of asphalt"; and would promote more visually appealing developments which <br /> have good traffic flows. He suggested that Mr. Schalliol provide additional details. <br /> Mr. Schalliol noted that the ordinance calls form connections to green ways, requires higher <br /> landscaping standards, better signage requirements, better qualifications for out-lots, architecture <br /> standards, and would move the city into the next level of development. All buildings would have <br /> to be brick or made of two (2) other components. There would also be flexibility for massing of <br /> restarants to provide for restaurant clusters. <br /> Andy Viderovich,a new land use planner with Area Plan then reviewed the Area Plan report which <br /> gave a favorable recommendation(copy attached). <br /> No one from the public spoke in favor or in opposition to the proposed ordinance. <br /> Council Member Kuspa stated that this is a very good bill, noting that he especially likes the <br /> signage requirements. <br /> Council Member Pfeifer inquired about how it would affect Lincolnway.\ <br /> Mr. Fozo stated that the properties would have to be rezoned to this zoning use for it to be effective <br /> on Lincolnway. He stated that there would also be grandfathering, which was confirmed by the <br /> Council Attorney. <br /> Following discussion, Dr. Varner made a motion, seconded by Council Member Kelly that Bill <br /> No. 26-03 be recommended favorably to Council. The motion passed. <br />
