Zoning and Annexation Committee <br /> October 22, 2003 <br /> Page 3 <br /> petition for rezoning which they need in order to qualify for grants. The property will be zoning <br /> CBD. <br /> Council Member Pfeifer noted that there have been several instances where a petitioner would like <br /> to have a business on the lower level and residential on the upper level. Mr. Sante stated that this <br /> would be a mixed use classification which are identified on the proposed zoning map. He noted <br /> that all maps can be accessed on the Baker and Daniels website. He also noted that eventually a <br /> "Book of Maps"would be filed with the Office of the City Clerk. <br /> Council Member Pfeifer requested that anything which has been sent to the various neighborhood <br /> partnerships and/or planners be also sent to the Council Members; and that any future information <br /> also be sent to the Council Members. She added that when a resident calls with questions about <br /> such information and the Council does not have it, that it would be helpful for all such information <br /> to be shared. <br /> Mr. Valanzano then reviewed the handout entitled "Summary of Selected Yard and Landscaping <br /> Regulations" (#3 handout attached). In response to a question from Council Member Pfeifer, Mr. <br /> Valanzano noted that landscaping will have four (4) components: perimeter yards, foundation of <br /> building, interim parking lot and parking lot screening. The proposed ordinance would establish <br /> minimum standards of required shrubbery. <br /> Dr. Varner inquired about lighting and whether it would be required to be directed to the site being <br /> rezoned and confined to the site. <br /> Mr. Valanzano stated that the proposed regulations do not utilize foot candle measurements. Mr. <br /> Fozo noted that the current ordinance does not utilize foot candle measurements. Mr. Valanzano <br /> noted that the height of fixtures would be addressed. <br /> Mr. Valanzano stated that the review of development plans would be in the exclusive control of the <br /> Area Plan Commission, and would be available for cluster subdivisions. PUD regulations would <br /> also have site plan requirements, with there being four (4) stages: zone map/preliminary <br /> plan/secondary plan/IOP. <br /> Mr. Valanzano then highlighted portions of the handout with the caption "Section 21-09.05 <br /> Development Review Procedures" (#4 handout attached). He noted that he has proposed new <br /> language on page 15 (2) Zone Map Amendments (B) which was not initially included in the <br /> ordinance on file in the Office of the City Clerk, with this language resulting from one of the video <br /> conferences. <br /> Mr. Valanzano added that in that same handout on page 16, he has proposed a new paragraph (D) <br /> Supplemental Plans, which also resulted from a video conference. <br /> Council Member Pfeifer noted that the new language addressing the Executive Director appears to <br /> be discretionary and therefore he or she could refuse to request information from a petitioner which <br /> the Council believes is needed. <br /> The Council Attorney noted that the Council may wish to consider having a zoning bill when read <br /> for first reading referred to the Zoning and Annexation Committee first, noting that the Council has <br /> a 30-day period to refer to the Commission under state law.
