Qommitt a deport <br /> Zoning anO ititintsation Qtommitteu <br /> The October 27, 2003 meeting of the Zoning and Annexation Committee was called to order by its <br /> Chairperson,Council Member Ervin Kuspa at 4:15 p.m. in the Council Informal Meeting Room. <br /> Persons in attendance included Council Members Kelly, White, Varner,Aranowski,King,Kirsits, <br /> and Kuspa; Assistant Director of the Division of Community Development Larry Magliozzi, City <br /> Attorney Charles Leone, Assistant County Engineer Laurie Johnson, Terry Bland of the 'iOuth <br /> O Sri()nit, and Kathleen Cekanski-Farrand, Council Attorney. <br /> Council Member Kuspa noted that the members of the Zoning and Annexation Committee included <br /> Council Members Kelly, Varner, Coleman and himself. <br /> Council Member Kuspa then called for a presentation on Bill No. 03-115 which is a proposed <br /> resolution to adopt a written fiscal plan and establish a policy for the provision of services to an <br /> area in Portage Township referred to as the New Cleveland Road Annexation Area. The <br /> companion Bill to Bill No. 03-115 is Substitute Bill No. 80-03 which would annex this property <br /> it <br /> into the city, more specifically the New Cleveland Road 21000 through 21500 Block. <br /> Larry Magliozzi, Assistant Director of the Division of Community Development made the <br /> presentation. He noted that this is a voluntary annexation consisting of 30.62 acres. It consists <br /> entirely of the right-of-way for Cleveland Road. Both the Board of Public Works and the Board of <br /> Public Safety have adopted resolutions in support of this annexation. <br /> Laurie Johnson, Assistant County Engineer noted that she represents the petitioner who is St. <br /> Joseph County and more specifically the County Commissioners. In May of 2002 an Interlocal <br /> Governmental Agreement was entered into between the city and the county calling for the county to <br /> construct the intersection and the city to take it over thereafter and maintain it when bringing it into <br /> the city. In response to a question from Council Member Kirsits, Ms. Johnson assured the Council <br /> that the intersection has been very well constructed. <br /> Dr. Varner then made a motion, seconded by Council Member Kelly that Bill No. 03-115 be <br /> recommended favorably to Council. The motion passed.Dr. Varner then made a motion, seconded <br /> by Council Member Kelly that Substitute Bill No. 80-03 be recommended favorably to Council. <br /> The motion passed. <br /> Under miscellaneous business, Council Member King noted that the Office of the City Clerk has <br /> informed him that they have received a number of calls regarding the Hurwich rezoning request <br /> which is not set for this evening. He noted that it is listed under unfinished business and would be <br /> set for 2nd & 3rd readings, public hearing and committee referral; and therefore may not be <br /> discussed at this evening's meeting under Council rules. <br /> There being no further business coming before the Committee, Council Member Kuspa adjourned <br /> the meeting at 4:21 p.m. <br /> Respectfully submitted, <br /> Council Member Ervin Kuspa, Chairperson <br /> Zoning and Annexation Committee <br /> KCF:kmf Attachments <br />
