Page 1 of 2 <br /> <br /> <br /> <br />INTER-OFFICE MEMORANDUM <br /> <br /> DEPARTMENT OF PUBLIC WORKS <br /> DIVISION OF ENGINEERING <br />TO: Anne Fuchs, Clerk <br />Board of Public Works <br />FROM: Zach Hurst, Project Engineer <br /> <br />SUBJECT: Award Bid - Project No. 119-093R <br />Southeast Neighborhood Center (United Way) <br />DATE: July 22, 2021 <br />On July 13, 2021, the Board of Public Works opened and read bids for the above project. <br /> <br />The bids are summarized as follows: <br /> <br />Bidder Base Bid Alternate 1 TOTAL <br />Ziolkowski Construction, Inc. $1,150,000.00 $16,000.00 $1,166,000.00 <br />The Robert Henry Corporation $1,145,505.00 $22,500.00 $1,168,005.00 <br /> <br /> <br />MBE goal: 2.6% <br />WBE goal: 5.1% <br /> <br />The project is funded by the Redevelopment Commission in the interest of constructing a <br />neighborhood center for United Way. It is United Way’s preference to award the base bid plus <br />the alternate item (adding shade structures), meaning Ziolkowski Construction is the lowest bid. <br />However, the Ziolkowski Construction bid must be rejected as non-responsive. <br /> <br />On Form MWBE-1.0 MWBE Utilization Plan, Ziolkowski’s bid stated ‘None at this time’, meaning <br />they were not able to meet the MBE goal set for the project. The City’s Contract Compliance <br />Administrator, Larry King, reached out to Ziolkowski Construction to determine whether Good <br />Faith Effort was applied during the search for an MBE firm to meet the goal. <br /> <br />Ziolkowski Construction noted an attempt to reach Talented Tenth Warehousing of South Bend <br />but stated in their bid documents that no response was received from Talented Tenth. Abraham <br />Marcus, owner of Talented Tenth Warehousing confirmed that Ziolkowski Construction had <br />requested a quote for work, but Mr. Marcus said he did not receive a response back from <br />Ziolkowski Construction after submitting his quote. <br /> <br />Ziolkowski Construction attempted to submit a revised Form MWBE-1.0 noting Talented Tenth <br />Warehousing as the MBE subcontractor for the project, but Form MWBE-1.0 cannot be modified <br />after it has been submitted as a bid document. As such, Ziolkowski Construction was not able to <br />
