ORDINANCE NO. 7e07- 5? ) <br /> AN ORDINANCE ANNEXING TO AND BRINGING WITHIN <br /> THE BOUNDARIES OF THE CITY OF SOUTH BEND, <br /> INDIANA, CERTAIN REAL ESTATE LOCATED WITHIN <br /> GERMAN TOWNSHIP, ST. JOSEPH COUNTY, INDIANA <br /> STATEMENT OF PURPOSE AND INTENT <br /> A Petition for Voluntary Annexation of property located <br /> in German Township, St. Joseph County, Indiana, having been filed <br /> by at least fifty-one percent (51%) of the owners or the owners <br /> of at least seventy-five percent (75%) of the total assessed <br /> value of the territory to be annexed, said owners being Jack M. <br /> Hurwich and Betty Hurwich Zoss, and said territory to be annexed <br /> being contiguous to the City of South Bend, Indiana, as required <br /> by law, and said Petition being in form and substance in compli- <br /> ance with all applicable requirements of Indiana law, and the <br /> Common Council of the City of South Bend, Indiana, after full and <br /> public hearing thereon, and being duly advised, now finds and <br /> determines that the Petition for Voluntary Annexation should be <br /> granted and that the territory should be annexed to the City of <br /> South Bend, Indiana, by proper ordinance. <br /> BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF <br /> SOUTH BEND, INDIANA, AS FOLLOWS: <br /> Section 1 . That the Petition for Voluntary Annexation <br /> executed by Jack M. Hurwich and Betty Hurwich Zoss for annexation <br /> of certain territory to the City of South Bend, Indiana, be <br /> incorporated herein and made a part hereof as Exhibit A attached. <br /> Section 2. That the real estate petitioned to be <br /> annexed is located in St. Joseph County, German Township, Indiana, <br /> is contiguous to the boundaries of the City of South Bend, and <br /> the petitioners are at least fifty-one percent (51%) of the <br /> owners or the owners of at least seventy-five percent (75%) of <br />
