• <br /> v f 1 <br /> r <br /> BILL NO. <br /> ORDINANCE NO. 77 ,4-e7 <br /> AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, <br /> INDIANA ESTABLISHING THE SOUTH BEND HAZ-MAT FUND. <br /> STATEMENT OF PURPOSE AND INTENT: The South Bend Common Council <br /> believes that it is in the best interest of the public safety and <br /> welfare to establish a Haz-Mat Fund to receive monies generated by <br /> the South Bend Fire Department' s response to hazardous materials <br /> incidents and that such monies be used to defray expenses related <br /> to Haz-Mat activities. <br /> NOW, THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF <br /> SOUTH BEND, INDIANA AS FOLLOWS: <br /> SECTION I . A new Sec. 2-168 shall be added to the South Bend <br /> Municipal Code as follows: <br /> Sec. 2-168 . Haz-Mat Fund. <br /> (a) The South Bend Haz-Mat Fund is established to receive <br /> monies generated by the South Bend Fire Department' s response to <br /> hazardous materials incidents. <br /> (b) The monies accumulated in this Fund may be expended <br /> for the replacement, repair, or purchase of Haz-Mat equipment, for <br /> training and supplies and to defray the expense of Haz-Mat related <br /> activities. <br /> (c) Monies remaining in the Fund at the end of the fiscal <br /> year shall not revert to the General Fund. <br /> SECTION II .
