<br /> <br /> <br />INTER-OFFICE MEMORANDUM <br /> <br /> DEPARTMENT OF PUBLIC WORKS <br /> DIVISION OF ENGINEERING <br /> <br /> <br />TO: Anne Fuchs, Clerk <br />Board of Public Works <br />FROM: Finn Cavanaugh, Project Engineer, Division of Engineering <br />SUBJECT: Award Memo #121-001: Curb and Sidewalk Construction 2021 <br />DATE: June 11th, 2021 <br /> <br /> <br />On June 8th, 2021, the Board of Public Works opened and read bids for the above project. <br /> <br />The bid is subdivided into 9 divisions, and the city reserves the right to award each division to <br />the lowest responsive and responsible bidder for that division. The attached bid tabulation <br />enumerates each bidder’s amount per division. <br /> <br />The bid submitted by TX Concrete did not contain a bid bond nor the documentation required by <br />the Responsible Bidder Ordinance. Evidence of MWBE Good Faith Efforts in forms 1.0 and 2.1 <br />was also not provided. TX Concrete’s bid shall be considered non-responsive and is <br />recommended to be rejected as such. <br /> <br />The bid submitted by Ziolkowski Construction omitted forms 1.0 and 2.1 pertaining to WBE <br />contact and utilization. M/WBE utilization goals were not met by the bidder, and a Good Faith <br />Effort was not fulfilled by the bidder due to a failure to advertise subcontracting opportunities in <br />general circulation. Ziolkowski’s bid shall be considered non-responsive and is recommended to <br />be rejected as such. As a note for the record, Engineering found that the amount of each line <br />item in Ziolkowski’s bid was rounded to the nearest dollar. The attached bid tab fixes this slight <br />calculation error by tallying each line to the nearest cent. The corrected calculation records the <br />total of all divisions at $639,008.24, versus the bid’s written total of $638,970.00. This correction <br />results in an “increase” of $38.24 but is immaterial to the results of the award, due to <br />Ziolkowski’s bid being non-responsive. <br /> <br />In the bid submitted by Selge Construction, the MWBE utilization plan fell short of the <br />established percentage goals specified in the bid documents. However, a Good Faith Effort was <br />fulfilled by the bidder, and this bid is considered responsive in accordance with the City’s MWBE <br />Inclusion Program Plan. <br /> <br />The bids by Rieth-Riley and Milestone Contractors North were both found to be responsive, <br />including all required documentation and meeting the established goals for MWBE utilization. <br /> <br />
