Dieter, Chairperson <br />Community & Economic Development Committee <br />South Bend Common Council <br />4th Floor, County City Building <br />South Bend, IN 46601 <br />RE: Commercial Real Property Tax Abatement Petition for: <br />RIVER ROCK, INCOPORATED <br />Dear Council Member Dieter: <br />Please find attached the Department of Community & Economic Development's report on a <br />commercial real property tax abatement petition for the above-referenced petitioner for occupying an <br />existing building that has been vacant at least one year. The building is located at 1433 Northside <br />Boulevard. Also attached is a copy of the petition, Statement of Benefits form, and supporting <br />information. <br />The report contains the Department's findings relative to the above petition. The petitioner proposes <br />to occupy the building formally occupied by the Boy Scouts. That building has been vacant one year. <br />The petitioner is asking for a special exception because the project does not meet the general <br />standards for real property tax abatement as set forth in the city's code. The State of Indiana <br />has a provision in its tax abatement legislation that permits the granting of up to a two year tax <br />abatement on a building that has been vacant for at least one year when it is occupied [See IC 6-1.1- <br />12.1-1(17) & IC 6-1.1-12.1-4.8]. The city's municipal code does not contain this provision and the <br />petitioner is requesting atwo-year tax abatement under that provision.
