refuses to fill out and sign the written consent form agreeing to
submit to the medical examination and/or testing and permitting
Ritschard to be apprised of the testing results or fitness -for -duty
evaluation (Consent Form 2), will be subject to immediate discharge.
(c) An employee who switches or adulterates any sample submitted for
testing will be subject to immediate discharge.
F. EMPLOYEE ASSISTANCE PROGRAM
1. Employees who are determined, as a result of the fitness -for -duty
evaluation, to have used chemical substances in excess of the limits set forth
in Exhibit A, shall be required to attend and pay for at their own expense
a treatment program offered by an outside provider. The cost of the
program will be fully explained to each employee. Refusal to participate
in or complete the program or the after-care program will result in the
employee's termination.
2. Employees who believe that they have a chemical substance problem should
promptly contact the President of the Company. The employee will be
given the opportunity to enroll in a voluntary program operated by
professional counselors. The cost of the program will be fully explained to
each employee.
3. Employees who participate in the program will be tested for chemical
substances in accordance with the provisions of the program until the
program ends. A positive test result following the commencement of the
program will subject the employee to immediate discharge.
4. Employees who complete the program will be tested for chemical
substances in accordance with the recommendations of the Medical Review
Officer. The days on which the testing will occur will be unannounced.
If an employee tests positive for chemical substances after the completion
of the program, the employee will be subject to immediate discharge. If
eighteen (18) months pass without a positive test for chemical substances,
there will be no presumption in the future that the employee is using a
chemical substance or is under the influence. If, in the future, the
employee is subject to action under this policy, the employee shall be
treated as if he or she never underwent a fitness -for -duty evaluation.
-6-
