Ritschard's drug screening policies and procedures, or fails the drug <br />screening test, the offer of employment will be rescinded. <br />3. Applicants who refuse to take the drug screening test or do not sign the <br />appropriate Consent and Release form (Consent Form 1) shall not be <br />offered employment. <br />4. Applicants who test positive for drugs with no legitimate medical <br />explanation shall not be employed. An applicant who tests positive may, <br />at the applicant's option and own expense, undergo confirmatory testing of <br />the original sample at the independent laboratory that performed the initial <br />testing. The GC/MS will be used for confirmatory testing. If the applicant <br />tests negative upon confirmatory testing, Ritschard will consider the <br />applicant eligible for employment. If the applicant tests positive upon <br />confirmatory testing, the applicant will not be employed. <br />5. The cost of the initial screening and evaluation will be paid by Ritschard. <br />E. FITNESS -FOR -DUTY POLICY <br />1. Compliance With This Policy is Considered a Condition of Employment <br />(a) If an employee refuses to comply fully with all aspects of this policy, <br />such employee will be suspended without pay pending completion of <br />an investigation. During the course of the investigation, the <br />employee shall have the opportunity to offer an explanation for his <br />or her behavior. Management will decide the course of action. <br />2. Possession, Sale or Use of Chemical Substances. <br />(a) Employees will be subject to immediate discharge if caught selling, <br />using, or being in possession of chemical substances (i) on company <br />premises, including the company parldng lot; (ii) on the job site; (iii) <br />while in or responsible for company vehicles at or away from <br />company premises; or (iv) while on company business at or away <br />from company premises, including the job site. <br />(b) An employee who is arrested for off-duty drug activity, including <br />use, sale or possession of narcotics, drugs or other illegal chemical <br />substances will be considered to be in violation of this policy and <br />
