ORDINANCE NO. l 0.3 ~ - ~ AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, AUTHORIZING PREAPPROVED PAYMENT OF CLAIMS STATEMENT OF PURPOSE AND INTENT The Board of Public Works for the City of South Bend, Indiana ("Board") is charged with the duty and responsibility to approve the payment of certain claims made to the City. The Board meets regularly to conduct City business that includes the approval of such claims, but the Board's meeting schedule does not always allow claims to be paid in a timely manner. The Indiana legislature has enacted Indiana Code § 36-4-8-14, as amended from time-to-time, which permits certain types of claim expense payments to be made in advance of Board allowance. The Common Council of the City of South Bend, Indiana has determined that payment of those categories of claims described in Indiana Code § 36-4-8-14 can be more effectively administered by the enactment of an ordinance authorizing such payment. NOW, THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA: Section I. The Board of Public Works of the City of South Bend, Indiana, on request of the City Controller, may make claim payments in advance of Board allowance of such claims for the following kinds of expenses: (1) Property or services purchased or leased from the United States government, its agencies, or its political subdivisions; (2) License or permit fees; (3) Insurance premiums; (4) Utility payments or utility connection charges; (5) General grant programs where advance funding is not prohibited and contracting party posts sufficient security to cover the amount advanced; (6) Grants of state funds authorized by statute; (7) Maintenance or service agreements; (8) Leases or rental agreements; (9) Bond or coupon payments; (10) Payroll; (11) State, federal; or county taxes;
