Zoning and Annexation Committee <br /> 2005 South Bend Common Council <br /> The February 28, 2005 meeting of the Zoning and Annexation Committee was called to order by <br /> its Chairperson, Council Member Ervin Kuspa at 4:12 p.m., in the Council Informal Meeting <br /> Room. <br /> Persons in attendance included Council Members Dieter, Pfeifer, Puzzello, Varner, Kuspa, <br /> White, Kirsits and Rouse; Don Fozo, Building Commissioner; Executive Director of the <br /> Department of Economic Development Sharon Kendall, Rita Kopala, Tedd Schaffer, Tom <br /> Skarbek, Larry Magliozzi, David Mirkin, Director of Public Works Gary Gilot, City Clerk John <br /> Voorde,and Kathleen Cekanski-Farrand,Council Attorney. <br /> Council Member Kuspa noted that the Committee members include Council Members Kirsits, <br /> Dieter,Rouse,and himself. <br /> Council Member Kuspa stated that the first item on the agenda was to review Bill No. 5-15 <br /> which would approve the written fiscal plan and establish policies for providing services to the <br /> Gregory A. Kizer and Marylou Kizer annexation area (copy attached). Council Member Kuspa <br /> noted that the annexation involves 3.2 acres in German Township. <br /> Larry Magliozzi of the Division of Community Development made the presentation. He noted <br /> that the annexation is 100%voluntary. The current police and fire districts would be expanded <br /> to include the new area. He concluded his remarks by stating that the proposed plan meets all of <br /> the state law requirements. <br /> David L. Mirkin the attorney representing Gregory A. Kizer and Marylou Kizer who has his law <br /> office at Wells Fargo Bank Building, Suite 400, 112 W. Jefferson Blvd., South Bend, IN 4660, <br /> then made a presentation on the companion bill to Bill.No. 5-15, namely Substitute Bill No. <br /> 91-04 (copy attached along with site plan) which would annex and bring within the city limits <br /> property in German Township commonly known as 52501 Portage Highway. He noted that he <br /> also represents the contingent purchaser,Dave Fishgrund.. The zoning request is to change from <br /> "R" residential in the county to "CB" community business in the city to allow the development <br /> of a shopping center, dry cleaner, restaurant and similar businesses. He noted that Ziker <br /> Cleaners would be one of the businesses and that there were no remonstrators at the Area Plan <br /> Commission meeting. <br /> Council Member Dieter inquired whether the proposed restaurant could be disclosed, and then <br /> inquired whether it was known for its margaritas. Mr. Mirkin stated that it was, a major <br /> restaurant in the community which was known for that liquid refreshment. <br /> Following discussion, Council Member Kirsits made a motion, seconded by Dr. Varner that Bill <br /> No. 05-15 be recommended favorably to Council. The motion passed. <br /> Dr. Varner then made a motion, seconded by Council Member Dieter to accept Substitute Bill <br /> No. 91-04.
