Zoning and Annexation Committee <br /> 2005 South Bend Common Council <br /> The May 23, 2005 meeting of the Zoning and Annexation Committee was called to order by its <br /> Chairperson, Council Member Ervin Kuspa at 3:30 p.m. in the Council Informal Meeting Room. <br /> Persons in attendance included Council Members Dieter, Pfeifer, Puzzello, Kelly, Varner, <br /> Kuspa, White and Rouse; Citizen Member Martha Lewis, Michael Danch,Doug Marsh,Director <br /> of Public Works Gary Gilot,Rita Kopala, City Controller M. Catherine Fanello, Brad Poulan, P. <br /> J. Thuringer,Larry Magliozzi and Kathleen Cekanski-Farrand, Council Attorney. <br /> Council President Pfeifer introduced Brad Poulan who is a IU South Bend student who will be <br /> interning with the City Council who she will be assigning to work with Council Membe;s. <br /> and Dr. Varner. -- --- <br /> Council Member Kuspa noted that the purpose of the Committee meeting was to consider the <br /> pros and cons of the items coming before it and make recommendations to the full Council. He <br /> noted that the Committee members include Council Members Kirsits,Dieter,Rouse, and himself <br /> as the Committee Chairperson. Council Member Kuspa noted that there was a quorum present. <br /> Council Member Kuspa then called for presentations on Bill No. 05-59 which is a resolution <br /> which would adopt a written fiscal plan and which would establish a policy for the provision of <br /> services to the Jo Ann Nucci Annexation Area in German Township(copy attached). <br /> Larry Magliozzi, Assistant Director of the Division of Community Development made the <br /> presentation. He noted that this is a voluntary annexation for 2.11 acres on the east side of <br /> Portage Road next to Village Farms. He noted that both the Board of Public Works and the <br /> Board of Public Safety send the Bill to the Council with a favorable recommendation. <br /> Paul "P. J." Thuringer, a Planner with Area Plan noted that at the April 19, 2005 Area Plan <br /> Commission following a public hearing a favorable recommendation on Substitute Bill No. <br /> 19-05 was given(copy attached). <br /> Michael Danch of Danch, Hamer&Associates, Inc. with offices located at 2422 Viridian Drive <br /> in South Bend made a presentation on Substitute Bill No. 19-05 which is the companion bill to <br /> Bill No. 05-59 and would establish the zoning requirements as well as formally annex the area <br /> into the city. Mr. Danch provided a preliminary site plan to the committee (copy attached). He <br /> noted that the land in question is across from TCU. He noted that he represents the current and <br /> contingent purchaser who desires to construct a 1-story 12,000 square foot multi-tenant building. <br /> They are proposing to have an ADA approved sidewalk from the apartment complex to the new <br /> development. <br /> There was no one from the public to speak in favor or in opposition to the Bills. <br /> Council Member Dieter made a motion, seconded by Council Member Rouse that Bill <br /> No. 05-59 be recommended favorably to Council.
