At this point, Council Member Rouse joined the Committee meeting creating a quorum of the <br /> membership. <br /> Council Member Kuspa inquired about the corner area, to which Mr. Magliozzi stated it is <br /> dedicated to right-of-way. <br /> No one from the public spoke in favor or in opposition to the two(2)bills. <br /> Following discussion, Council Member Dieter made a motion, seconded by Council Member <br /> Rouse that Bill No. 05-113 and Bill No. 45-05 be recommended favorably to Council. The <br /> motion passed. <br /> Council Member Dieter then made a motion, seconded by Council Member Rouse that Bill No. <br /> 05-96 heard at the beginning of the meeting be recommended favorably to Council. The motion <br /> passed. <br /> Council Member Kuspa then called for a presentation on Bill No. 42-05 which is a rezoning <br /> request for the property located at 1951 East Fox in the 5th Councilmanic District. <br /> P. J. Thuringer, a planner with Area Plan reported that the Area Plan Commission gave a <br /> favorable recommendation to rezone the property from Single Family (SF2) to Officer Buffer <br /> (OB). <br /> Debra Voltz-Miller, an attorney with offices located at 108 North Main, Suite 423 in downtown <br /> South Bend made the presentation. She noted that the property would be used as her law office. <br /> No one from the public spoke in favor or in opposition to the Bill. <br /> Council Member Dieter made a motion, seconded by Council Member Rouse that Bill No. 42-05 <br /> be recommended favorably to Council. The motion passed. <br /> Council Member Kuspa then called for a BZA report and a formal presentation on Bill No. <br /> 05-109 which would approve a petition of the South Bend Board of Zoning Appeals for the <br /> property located at 2004 East Edison Road. <br /> Don Fozo, Building Commissioner reported that the Bill was heard by the Board of Zoning <br /> Appeals on August 18,2005 and is sent to the Council with a favorable recommendation. <br /> J. Bernard Feeney of Lang, Feeney and Associates, Inc. with offices located at 715 South <br /> Michigan Street in downtown South Bend made the presentation. He noted that he is acting on <br /> behalf of Tiberius Mihalache who recently constructed a new office building at the site. The <br /> area is properly zoned however he is in need of additional parking. An agreement has been <br /> reached to purchase enough property to locate six (6) additional parking spaces which could be <br /> constructed if the special exception is granted. <br /> No one from the public spoke in favor or in opposition to the Bill. <br /> September 12,2005 Zoning and Annexation Committee of the 2005 South Bend Common Council -Page 2- <br />
